Check n go Installment Loan- HELP!
Date: Mon, 03/05/2012 - 11:46
Can anyone help me with this? I am not getting anywhere with the collections department. All they have is this past due payment there, not my loan balance and they won't work with me beyond that. Is there another number to call rather than collections to try to work this out???
I sent an email to their customer service and collections department as well:
Dear Collections Department,
I attempted to call today and work out a payment arrangement with your department today. I can only seem to work out a payment for the "past due" amount. In addition, I was told if I don't submit a debit card number today, I will be marked as a "refusal to pay." That is a bit rash, as I am only three days past due. I am not refusing to pay, I simply don't have the money right now. I can give you a debit card number, but I can't guarantee that the money expected will be on it every 2 weeks.
I found the collections people I talked to today to be rude and very disrespectful of my situation.
I also would like to negotiate monthly payments for the balance I owe. As a CFSA Member, I am very disappointed that Check n Go will not work with me. I was even told I had to force the account to collections to even get a payment arrangement. Now I have to pay another $680 while my loan sits and accrues interest, and I simply can't make the huge payments. I have to default completely on this to make arrangements? This seems ridiculous, when I am willing to work with your company on this.
At this time, I am revoking any ACH revocation and wage assignments. I wish to work out payment of this loan. I have already paid $1330. Please work with me on this.

What state do you live in? Is your lender licensed in your state? If not, then you are required to pay only the principal amount. No need to pay any interest or fees to the illegal lenders. If they are licensed, then it???s better to take help from a debt relief company.

Dealing with Check N Go myself I know what your going through, they aren't helpful at all and when you ask for a extended payment plan they say they do not have it avaliable, which is in direct violation with their CFSA agreement, also the fact that they were rude to you is also another violation, report them to the CFSA.
"Should a customer of a CFSA member company have difficulty paying back a loan when due he or she may enter into an Extended Payment Plan, a provision of the CFSA???s Best Practices that allows the loan to be repaid over a period of additional weeks. This option is provided to customers for any reason and at no additional cost to the borrower.
If a consumer does not choose to take advantage of the extended payment plan, each company has its own collection procedures, but every CFSA member company is committed to collecting past due accounts in a professional, fair, and lawful manner as required by our Best Practices. If necessary, your payday advance company may turn an overdue account over to a collection agency.
Visit the CFSA website http://cfsaa.com/ for more information, also you can file a complaint about them as well. With it being a installment loan instead of a Payday loan the rules may be different, you'll have to contact the CFSA and ask, but I'd report them for just being rude.
Update
Well, I got them to take $100 that I really don't have. I have to default for 30 days in order to get an alternative payment plan. It seems to me that if they are CFSA, they should offer it sooner. Instead, I have to go through Heck to get a plan!
I am heading for Wisconsin Chapter 128, I think. I have learned a lot on this forum, but I simply can't make the payments these companies want. I still have four other large ones that I won't be able to manage, even on a payment plan.
I'll keep you posted. I am so frustrated! I still need to deal with the illegal lenders too. I owe three of them the principal, and the other two I overpaid. It looks like I am in for a fight with usacashexpress. Minute Funds is at least being considerate, although they claim they don't need a Wisconsin License because they are licensed in Utah.
This leads me to another question. I have seen in the forum in older posts that if a lender is licensed somewhere, then it's legal in Wisconsin. Yet when I look at the Wisconsin Statutes, it says a license is required by the Wisconsin division, period. I can't find anywhere in the Wisconsin law that they can be licensed in any state. Am I reading it wrong, or did it change recently to Wisconsin license required?

Keep in mind that under the CFSA, two things apply:
1. State laws overrule the CFSA agreement.
2. EPPs need to be set up PRIOR to default.
Call the 800 collections number on the CnG website and ask to talk to a supervisor. Set up a payoff you can afford. Try to settle for either less than the full balance due in 4 payments, or the full amount due in more payments.
