Several months ago, in a terrible bind.... I made the dumb decision to sign on for one of Western Sky's famous loans. They in turn immediately sold the loan to Cash Call.

I borrowed $5,000, and I am supposed to make 84 monthly payments of $486.58. Yes, that would total over $40,000 in payments. I can not sustain this, somethings gotta give.

Can anyone help me here, is this even legal for them to charge these interest rates?

Payday lending is prohibited is New Jersey. So you are required to pay only the principal amount. As you have overpaid them, ask them for the refund. Close your bank account to stop unauthorized withdrawal. Check out this link to know how to deal with illegal lenders:

Your loan was originated by Western Sky which is an illegal tribal lender. Since it is illegal for payday lenders to operate in the state of New Jersey, you are not liable to pay them in full, just the principal amount. They can neither take any legal action against you nor can do much of anything else.

Follow this link and you'll get a fair idea of how to handle illegal payday lenders: http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html

Hi there... I also have a Western Sky/Cash Call installment loan and live in NJ. I e-mailed them the letter to revoke my ACH authorization and actually haven't heard from them since. I did get a copy of the loan agreement in the regular mail the other day, and I think this was thier way of trying to tell me the loan is "legal" and binding.
.
It doesn't matter though, because I'm getting ready to mail them a payment towards the end of the month. I'm going to try a method that worked for one of my friends:
.
Along with your money order/cashier's check that you will be sending (certified)... send a copy of a letter that states "By cashing this check, you are agreeing to settle this debt for only the principle borrowed in the amount of $___. The principle will be paid off in ___ installments of $____, with the last installment received by (date)."
.
Anyway, I'm going to do that with Cash Call and any other vendor that gives me a hard time about only paying back the principle. We'll see how it works out...

I have 4 loans some of which are called payday loans but some are called installment loans. I live in NJ.

Sierra Lending
Western Sky/Cash Call
Seaside Dollar - out of Belize
Great Plains Lending - out of OK

Where can I turn for help. These fees are costing me $1000 month with nothing going to principal really. I had to do these loans as a result of loss of income during Hurricane Sandy. Help

Click the link in Ohiogal's post above yours and that explains a lot about the steps you need to take. I'm not sure about Sierra Lending but the rest of those are illegal tribal/offshore loans. You would be responsible for principal only.
