Hi,

I recently got into some financial troubles and ended up taking out a couple of PDLs, which I'm now finding was not very smart at all. I live in Georgia, and I'm at my wits end with what, if anything, I can do. Could someone point me in the right direction?

first off welcome.second we can so help you here,but we need more info like.

1)names of each lender
2)amount borrowed from each
3)amount debited by each thus far


since i know you are in GA i'm also guessing these are internet.meaning they are most likely illegal,but we need to know for sure.please provide the info requested and we can and will help you here.

I have the following (and I'm a bit ashamed of my stupidity):



  • Lakota Cash. 400.00, 480 debited in fees only (120 per two weeks)
  • Advancemetoday.com - 250, 240 debited so far (60 per two weeks)
  • White Hills Cash (2) 100 each, 120 paid on one, 80 on the other (30 per two weeks)

These are internet loans and I had nowhere else to turn.

i've got news for you.all of these are illegal in GA.therefore not only do you only owe the principle,but those fee debits get deducted from that.here is what you really owe.

lakota owes you 80.00
advancemetoday you owe 10.00
white hills offset as you overpaid by 20.00 on one and owe 20.00 on the other.

you need to go to ohiogal's sticky titled (dealing with illegal lenders)at either the top of this forum,or on ohiogal's signature.follow every step.the first is to close your account and open a new one.do that asap as again the only one you owe is advancemetoday and that is only 10.00.

Congrats on dealing with your illegal lenders Brad!

As you go forward, be careful with Advance Me Today. Make sure you completely close your account before contacting them at all. Those guys are really, really horrible people. They will scream at you, threaten to sue you, the works. Also, if they have any reference numbers for you, they will start calling them incessantly.

I had three lenders, and they were the worst BY FAR.

Thanks everyone for the help so far. I've got a new bank account open, switched my direct deposit for work over to the new account and will be closing the old account today. Tomorrow the letters go out and I'm braced for blowback from them, but I think I have what I need to manage the storm, thanks to this forum.

I totally agree,
I have been dealing w/ Advance Me Today since October. I haven't received any further calls from them but at the begining it was a challange.
If they can they will constantly attempt to withdraw funds from your account even though you have revoked it.
I checked my account on their web site and it says its been charged off...
I'm just waiting to see what will happen next, even though the Department of Corporations did send me a copy of the order they were served with.

Wells Fargo is giving me the run around currently. My account went negative and they don't seem to care about the ACH revocation letters I want to send. They keep wanting me to file a fraud claim but I'm not sure what to do. I don't have the money to bring the account current at this time and they are also giving me a hard time about freezing it. I have not sent anything to the lenders yet, but I'm stressing out majorly right now about what to do with the bank that won't cooperate.

Okay, I finally got through to someone who knows what I'm trying to do. I need to stop back into a branch (after stopping in one and them not knowing what to do) and tell the banker to put a stop to all debits on the account until I can get the negative balance fixed. I'll be doing that tomorrow, then the ACH revocation letters go out.

you see a manager,not a teller.a teller will do stop payments.those cost money,and do not work.the manager is the one you see.you can get one of two things done.

1)bring the ACH revocations and all other papers and get those debits returned and the NSF fees refunded.
2)if they won't do that get the account on (deposits only)that is something only a manager can do.

now the D.O. is temporary only about a month or two,and only for negative accounts.again see a manager only for this.keep us informed.

Yeah, this point in the process can be tough. I'm going through this with Bank Of America right now. Debit blocks, balance holds, I've been promised everything in the book, but it never seems to actually work. I swear I've been there 10 times in the last 2 weeks. I'm beginning to hate bank lobbies and their stupid cushy chairs...

Round two at the bank. I called the 800 number Friday night again and they told me I'd need to go into the branch and get a debit block put on my account. I went in today to do just that, however, I was told that the "system would not let me do it, I think because you are overdrawn". On top of that, he asked if I could come up with the money so we could just close the account. *sighs* I don't need this additional stress. I'll be calling the 800 number again as he suspects they might have started something. All I want to do is make sure it's locked down. More after I make another call.

did you see the manager at the branch.do so,and accept no substitutes.the drones on the 800 line won't tell you about (deposits only)as only a manager can do that,and it's for overdrawn accounts only.try to stay off the 800 line again as their info is basic at best.

First, thank you all for the information. I've calmed down now, and I need to make sure I either take a copy of Regulation E with me or remember to mention it to the branch manager (I'm going to a different branch tomorrow; The first one proved that they don't particularly care) that they must heed my request. I don't get paid until Friday, so I won't be able to get the account fully out of the red until then, otherwise I'd have closed it long ago.

It really does matter who you talk to. I went to a different branch and spoke with a manager there. Without question, she applied the block all debits to my account and as soon as I can get it to a zero balance I will be closing it. I got her to print off confirmation of that in case something does come through. Now comes the revocation letters and ensuing fight.

Once again, thanks to everyone for the help, I may actually sleep tonight. :) ACH revoke letters have been sent and refunds asked for. Bank account is secured, and there is NO way I am ever getting into this kind of mess again. I'll keep people posted with how things go as I don't think I'm out of the woods with these people just yet.

I just started this process too. And, with a little courage from OhioGal's knowledge. Hopefully, things will work out on the banks end. I Just worry about the after shocks the PDL places will cause, these places are just shameful. It truly is amazing I wish I would have never done it had I known. Good luck!

Wow!

I wish I could get a letter like that. That's the dream response.

I've still been dealing with AdvanceMeToday. They've stopped responding to letters and don't call anymore, but they tried to debit $622 out of my account a couple hours ago (midnight, my time) but my bank account is finally closed so they didn't get a dime. They did send me a "thank you for your payment" letter though. Hilarious.

It's sorta fun watching them desperately try to get at my money and have absolutely no success!

Just an update. The debit block worked just fine, nothing more came out of Wells today (payday). White Hills actually made good on their email and my old bank account got a credit of 200, which is enough to officially close it out today. I'm still prepared for a bit of a fight with Advance me today, as they attempted to collect the entire amount with their ACH attempt (and funnily enough, I got a "thanks for your payment" email). I'm almost out of the woods thanks to the fine people at this site.

since you think i still owe you when you got 480.00 on a 400.00 loan i'm filing complaints with my AG as well as the FTC.i will not talk about this stupidity over the phone as again this loan by my scorecard is paid.i have revoked your ACH authorization as well as any wage assignments.btw do you really think i want to maintain any status with an illegal tribal lender?

I've sent my revocation letter which contained the statements that payday lenders are illegal in Georgia and it has gone ignored. I've already repaid the principal on this loan and I'm not sure how to follow up here.

First, I wanted to thank you all, again, for the help provided to me so far. It's been three months since I've started this process. I still have two lenders hounding me.

Lakota Cash
AdvanceMeToday

Lakota is contending I am bound by tribal law, even after reiterating my original letter multiple times. They have now sent me a note outlining the tribal law in the paperwork I originally signed and are threatening further collection actions. I've sent complaints once to the FTC and state authorities, but I suspect I will need to do so again.

AdvanceMeToday is starting to call me outright, at work, even after I explicitly forbid them to in my note I had sent to them. They have not provided me a mailing address and are still after the original overblown amount.

Is there anything else I can / need to do? I followed Ohiogal's information to the letter at this point.

This chain of posts is simply amazing. Here we have a struggling young man, Brad, who took out what I would classify as modest unsecured loans. As we know, PDL's excel in illiegal activities, while many borrowers take advantage of the PDL's by borrowing money from them interest free. The borrowers know these lenders are doing so illegally, and thus they only owe principal. This wink & nod activity creates negative side effects.

In Brad's case, he has had to invest significant time and endure a lot of stress just to dispose of the problem. For others on these boards, I would caution you against using these interest free loans.

Brad, reading through your plight, I send you my sincerest sympathy. You are a nice person and didn't deserve this. You are trying to make things right. You will face more hardship. I hope you pull through, and I know you will be stronger for it.

If you'd like to share more details of your overall financial situation, I would be most interested. Thanks in advance.

I never thought about this before- I can purposely take out what I know are illegal payday loans on the Internet and use the proceeds to pay down interest bearing credit card and legal payday loan debts.

My plan as follows:

-Open a special purpose bank account for debits.
-Get a new phone number for this purpose.
-All on one day apply for every illegal payday loan I can get.

Use the free float to reduce my high interest debt. Hold off paying back the interest free illegal loans as long as I can. Rinse and repeat. Genius. Thanks Chief!
