My knowledge of Western Sky is that they indicate they are bound by tribal law. I don't believe they are licensed to do business in your State. If they are not licensed to do business in your state, then you are only obligated to pay them back what you originally borrowed. For example: if you borrowed $500 and have already paid them back $100, then you only owe them $400. The very first thing I would do is immediately close my bank account so that they could not take any more money from you. Second, find out for sure if they are licensed in your State. If they are not then send them a letter (sample you can find on this site) regarding illegal lender. Hang tough and don't let them scare you or bully you into paying more than you actually owe.

you are right all pdl's are illegal,and western sky is tribal meaning they are also illegal.now i need the following
1)names of each lender
2)amount borrowed from each
3)amount debited by each thus far in fees,or rollovers
you see being as no lender is legal not only do you only owe the principle,but being as they are illegal anything debited in fees/rollovers gets deducted from the principle balance.now i do need you to got the sticky titled(dealing with illegal lenders)at the top of this very forum,or in ohiogal's signature.it has step by step on how to get these out of your life.now you need to do the first step immediately if not sooner,and that is closing your account and opening a new one.that is key,but try to provide the info requested as you might be shocked at how little if anything you actually owe.
i took a loan out with us fast cash for 300 have paid 90 dollars
i took a loan out with us fast cash for 300 have paid 90 dollars 4 times in rollover fees. now this next payday they will take 140.00 out in fees and principle.
Cash call i took out1500.00 and paid 196. this past pay and the pay before that 48.
i also have a payday loan out with a company that i can not remember the name off. i took out 500 but never paid it back. i had fraud on my account and closed that account before the first payment came out.
i have one with cash yes that is in collections for 300. they were calling me and put me to a collection agency. i paid the agency about 400. that was not enough to pay what they said i owed with all the fees for defaulting and the agency fee. i stopped paying now they have stopped calling. it has been several months since i heard from them.
then i have one with first bank of delaware now called plain green that is an installment loan that i took for 800. paid maybe 200. then stopped paying. got sent to a collection agency who threatened a law suit. so i set up a payment arrangement with them for 75 a month. paid that for like 4 months then stopped. now they are calling and treatening again.

you really need to close that account as again none are legal.in fact.

2)cashcall was originated by western sky and i'm guessing they took the 500.00 loan origination fee.illegal therefore you were loaned 1,000.00 and owe 800.00
3)cash yes is done as since you paid 400.00 to a bottomfeeding scam
4)how long ago was the plain green loan?i ask this because FBD(first bank of delaware)stopped doing loans about 1 1/2 years ago.plain green being tribal and illegal like to lie and say that the loan was FBD,but if it was within the last year then it is not FBD.

the loan with First Bank of Delaware was taken out before it was turned into plain green. so when the debt collectors call they specify they are collecting for First bank of Delaware. My concern is can they take me to court over this? They keep threatenig too.

a couple more things regarding FBD.
1)if it was taken after aug 2009 it is illegal no matter what
2)the collection agency unless they have a lawyer is lying as only an attorney can sue
3)to sue they have to sue in your bourough only
4)did this place threaten to garnish?if so then they are not legit as PA is non-garnishment
if you took the loan after aug 2009 then it is not legal and i doubt the CA is legit.

If you signed the loan with FBD while it was still FBD, it's legal. However, you may be able to negotiate with them to either reduce your payments, reduce your interest rate to the legal cap in your state or settle the account for a lessor amount than what is currently due.
Contact them and try to work something out.

a couple of points again.
1)FBD(first bank of delaware)stopped lending in PA when the new law was passed in 2009.
2)i'm guessing the OP never recieved anything in the mail from this collector.
3)plain green used the name FBD for the first nine months of their existence.
4)anybody can invoke a name i can use that exact name over the phone.BFD.
sorry ohiogal,but unless the OP got a letter or something from this collector i wouldn't even talk to them until i got something in writing first.i also wold ilke to know the name of the collector,and what specifically they threatened.

Ah, a collection agency. I didn't see that. This could go either way. If FBD is using the CA to collect, and they can verify, you owe it. If Plain Green is using the CA to collect, they won't be able to make that work. If it's just a CA trying to collect (they now own it), they're out of luck.

for one they did give it to this kramer & assoc.second if this loan was FBD they would state so in the email.bottomline you only owe 600.00,and you need to file AG complaints against all including plain green.they were tribal and illegal.

My loan was sold to kramer and associates who on there website say they are a collection agency who also has lawyers on staff. So can they sue me or garnish my wages. Whenever I talked to the people at the ca they were so rude. The one guy refused my payment option that I offered. So I called back the next day and gt some one else who accepted it but now I haven't paid in some time cause I can't afford it with all the other pdl loans I took. So I am scared and not sure what to do. I don't want to be sued. But like I said they threaten legal action if I don't pay.

i was responding to the other poster.the CA is a bottomfeeding slime in NY.they won't do a thing.think about it a second.they wouldn't be repeating the same threats if they could carry them out.this is an illegal loan in PA,and PA is non-garnishment.you need to report both the lender,and the CA to your AG asap if you haven't already.again a bottomfeeder in NY that can't do what they threaten.report,don't pay.
