PDL Threatening Jail for Check Fraud!! So afraid! Please help!

I got into financial trouble late last year and took out some pay day loans. I am trying to get things repaid, but it will take months to repay the overdraft fees , loans, etc.
I got a cal from PayDay loan yes!--- the man saud he was in their fraud legal department and that if I did not make payment arrangements, they would proceed with reporting me for Internet fraud, check fraud. I am so afraid---haven't been able to sleep since the call.
My question is: Can they do that? I have no intention on no repaying my loans, just hit a rough spot financially. Is it check fraud if my bank account doesn't have enough money to cover the automatic scheduled debit from a pdl company?
The pdl company lent me $350 in October, with $175 a month interest. They debited two months from me, but my account has been insufficient ever since (someone committed fraud on my account, so I had to get a new account).
The rep told me their website has been hacked, so the negative reviews about their company online are due to foreign scanners who threaten people w/ arrest at their job, etc. He didn't clarify his threat---just said that even though no actual checks are involved, it is still check fraud for not having funds repeatedly.
We worked out a plan, but he said I could only pay via western union or a pre-paid disposeable debit card. Is this safe? I told him about how I heard his company just takes money out of peoples account in excess of what they owe, etc. He said those were the Indian Internet scanners.
I am so afraid. I got in this mess due to health issues and am trying to get my life back together. The anxiety is killing me. Now I am worried that my overdraft status at my bank could be viewed as check fraud (though a good chunk is just NSF fees).
Please help!!! I've been praying and trying to keep my head together mentally----just feel so overwhelmed.


I am not one of the experts here, but your story is familiar so I can a least point you in the right direction.

First of all, don't answer any more phone calls from them. The company you are dealing with is ILLEGAL and you do NOT owe them any money whatsoever. The can NOT bring legal action against you (for check fraud or anything else) and they are simply trying to scare you into giving them more money.

Read the whole thing and also search around this forum and you'll see that you're not alone when it comes to dealing with these scammers.

Again, don't be afraid of them! They can't do anything to you. Do not talk to them ever again over the phone and follow the instructions at the link above to get yourself out of this situation.

Which state are you in and whats the name of the payday lender? This bit of information will help us to establish if payday loans are legal in your state and if the lender is licensed to operate in your state.

As mentioned in the above post, lenders don't have the right to file criminal action against you. Its just one of the many dirty tricks they use to coax people into paying.

first off steven again needs to read threads first.second paydayloan yes is an out of the country illegal pdl that can't do spit,but call and illegaly threaten.the OP needs to file a police report.plus AG,and FTC complaints against this piece of dirt.also follow zach's advice and either do not talk to them,or hang up without a word if you get stuck on the phone.they can't do a thing they threaten.

The payday loan company that called and threatened me is Pay Day loan Yes! They have also recently changed their name.

I spoke with a guy who said he was in delaware, and sounded from Deleware. He said he would send me a new repayment plan. He said I could repay via a prepaid visa/debit card or via western union. The plan he made would result in my paying an additional $590 in addition to the $350 they already debited from my account.

I originally borrowed $350 and the interest per month is $175 per month. They were able to debit $175 for 2 months, before my account became overdrawn and I was unable to continue paying.

What do I do if they don't send me the repayment plan agreement, but continue to harass me with threatening check fraud? I told the rep that I had read things about the company withdrawing people's entire bank accounts, etc., and he replied that their website was hacked by an international hacker (Indian) and that those people who call and harass borrowers are not affiliated with them.

do as i advised above.now that i know the particulars you owe nothing as this is an illegal lender,and as such you only owe the principle.those 175.00 debits covered that.do not speak to this loser(yeah i said loser)anymore.if you get on the phone.hang up without a word.this loser(yes i siad it again)can't do a thing he threatens.that is called a scare tactic,and the only way it works is if you believe it.don't believe it.report and ignore this loser okay.

I am also dealing with this company. I paid them $875 for a $350 loan. That is plenty, and they will get no more, no matter how much they try to call and harass me. The bottom line is, THEY CANNOT COLLECT IT BECAUSE THEY ARE AN ILLEGAL LENDER.

Read some other threads about Payday Loan Yes and USA Cash Express. They use bogus addresses, including the address of Wrigley Field. The people that call you say they are from collections, legal, etc., but if you pay attention, it is the same voice. They will tell many lies and break every rule of the Fair 1.

I simply ignore them. So far no call today. I am figuring that they finally realized I am not worth their time because I know better. I asked for a collection letter 9 days ago and never received one.

Everything they say is a tactic to try to scare you into paying them even more money. It is all they have because the loan is uncollectible.

Like others who have replied, when the Paydayloan-Yes! now called USA Cash Express--First National Services, called me the guy said he was with the fraud department, etc. I was afraid and asked for a payment schedule (they too, already withdrew $350 on the $350 loan, and wanted an additional $500 (down from $900) in monthly installments). I asked the representative to send me actual paper documentation of the agreement as I had heard negative things about their company.

Well, I never received that documentation and the man said he would look into it. This company doesn't appear to be licensed in California. Can I ask them to cease and desist with their collection attempts?

BBB has a lot of complaints about them, but the company hasn't replied to any of the complaints, and the BBB says they are unable to locate the company.

What can I say to this company to have them leave me alone and stop threatening me?

I'll reiterate what I have said before. I followed paulmergel's advice, and so should everyone else. First of all, it looks like you don't owe them anything. Make sure your accounts are secured and out of their greedy claws as well! If they have your account number, CLOSE IT.

Now, file your complaints to your AG office and to the FTC. It is all we have, and the FTC will act if they get enough complaints.

Finally, if they call, hang up. Do not talk to them at all. Not a word. If they call and you recognize the caller ID, pick up and hang up (they hate that.. they can't even leave a voicemail). If they call work, hang up. Let anyone else know that answers the phone to do the same.

They will try to track down other phone numbers for you. They called my son's cell phone. Warn anyone that you think they may call to hang up, it's fraud.

The only way they will stop harassing you is to ignore them. If you send letters or talk to them, it encourages them. Even if the message you are conveying is that you know what they are up to. They will keep it up as long as they can get a human on the other end of the line.

Don't be afraid of them, they are illegal, they know it, and they will go to extremes. They can't do any of the things they say they will.
