Received call that Payday Loan is taking me to Court...Help!
Date: Mon, 03/12/2012 - 14:40
I received a call, as well as many other family members have received a call from a William Kensington, stating that he will be at my house or place of employment because he has a an order that was submitted to his office advising that a request to have me sign for a certified notice of intent. He said that I have an opportunity to contact the mediation firm to discuss the matter, and that office can be reached at 855-804-1795. With a claim number. He said I was placed on his schedule for Tuesday March 13. I called the number that he gave me, and it is the Recovery Processing Systems office. The first time I called I spoke with someone who said well, didn't you get all the information in the message. I asked for documentation on this bill, and he said that it was from Payday One, and that they were taking me to court. And that i could stop it for 1000+ change. I said that i didn't have that kind of money and would like to set up a payment plan. He said that there was nothing he could do. And that they didnt' want to do that. He said that the payday loan was from 2003...or maybe he said 2004. I can't remember. But it was around that time. I do remember getting a payday loan, and i thought i paid it off, but I could be wrong to be honest. And i don't have any documentation about this transaction. Anyway this man told me that they were pursing me because of fraud and soemthing about hot check. And that I would get served on tuesday and good luck in court.
I received another call from the william kingsington guy so i called back to the number that he gave again, and i asked for him this time. The person was another guy, and he was alittle nicer this time. He said that that person (william) did not work there, but that he was probably the server guy calling for RPS. I informed that I had received the call and that my family did as well, and that the guy told my family that i would be going to court, and to jail. And that my family was very distressed. As was I. He told me about the Payday one, but told me it was from a few years ago, and that they were pursing court. But that he could not help if i had signed for the court paperwork yet. I told him i had not. He said well, they wont be there until tomorrow. I told him that I would like to do payment arrangements and that I could not pay the 1000 dollars, which he said that was from the original amount, court fees and such. I told him that i had thought i paid it off? And that i would like documentation. I was told that I would get it after I paid it off. He asked if i had received anything about this Payday loan, I told him i had not. He then said that he could contact the payday loan place, and see if they would agree to payment arrangements. I was placed on hold, and he came back after a litle while and said that i had two options, one was for a two time payment of 400 and change, for this month and next. and the next was 250 at this moment, and 150 for the next 6 months. Give or take on the money amount, but roughly the amounts. So At this point I told him I could not make payment arrangements until the 20th of this month. He said that I could call back and try to gather money, but that once i signed for the court paperwork, then he would not be able to help me. I told him that i need to know the original amount, and that i would like something maybe emailed to me about this debt. He then told me that the person who would do that was out of the office and won't be back until tomorrow. I said ok....
Now...I've searched for the RPS website, and found it, and all the people who say that the RPS is actually a scam....but is this something i should just ignore? I mean, I'm not sure of what to do! I know that they can not pursue me for criminal intent, but this sounds pretty serious to me....What do i do? Do i wait for the paperwork, do i not sign for it if someone actually comes???
Thanks for all your help! Sorry for the long post, and any typos.

Thanks SoapLady, I am expecting them to be here tomorrow. I will take what the processing service gives me, and will try to do this on my own, or try to seek legal counsel, but at this moment i can't make a payment. So I am stuck, and will just accept what I get. Thanks for your help.
