They just won't let it go....

I have rec'd about 16 calls to date from EAG since Jan about an illegal payday loan that I overpaid but they say was not paid in full. I let each call to vm and each one says I will be served in my county, and to date nothing. Their basing this on "fraudulent check" since I closed that account to stop the overpayments to various illegal payday loan companys months ago.

Got another call today from another employee that I will have a process server deliver papers for my signature on Monday morning. If I call them back to resolve this matter before the server arrives Monday morning they will stop the server. Here's where it's new and interesting, "If you don't sign the papers that doesn't mean you are compliant but will be a judgement in your county". WTH?!?!?

If I don't live in the county they attempt to file in what happens? But I'm quite sure they won't file since they haven't done so the 13 previous times.

I don't want to communicate with them at all but these one a week phone calls are irritating!!! How to stop them??

They appear to be violating your rights under the Federal Fair Debt Collection Practices Act (FDCPA).

If you have an e-mail address, write them and tell them to CEASE any and all communication to you regarding the illegal pdl. Note, also in your e-mail, that they have threatened legal action that they have not or intend not to do (you say 13 times?) and that is most certainly in violation of the FDCPA as I understand the law.

Not responding to them, either via e-mail or written snail mail, isn't the right path to take. It won't help you stop them. But an e-mail - or if you have their fax number and access to a fax, you can use that, too since it's date/time stamped - noting the above will make them stop. Save all voicemail messages they make after you've sent them the Cease and Desist.

save all voicemails as claiming they are a process server is a suable offense already.compile your proof starting now and sue them.that would get them off your back,and put $$$ in you pocket as well.

Is this the PDL or a collection agency calling? If it the PDL themselves, there would be no 1 as the act does not apply to the creditor, only third party collectors. Deal with the irritation...let it go to voice mail. Or have fun with them knowing they cannot do squat to you. Offer to meet the process server at your local police department. Email them to death with the fact that they are illegal...they are simply trying to break you down and scare you.

you're right,you're right.being as this is an illegal lender a lawsuit is pointless.i don't however advise"messing with them"as some are stupid to the point as they will read any communication as a possiblity of them getting paid.ignore all calls and messages.i do sometimes play some messages when i need a good laugh,but that's just me.

This is not the original illegal payday lender, they are acting as "debt collectors" for those illegal lenders.

I figured not engaging them would be the right tactic but they just don't seem to get it. Most swindlers realize after a certain amount of time of no response they aren't going to get anywhere and stop but they keep going!!!

I don't think they will heed Cease & Desist letters so I have their number blocked and will just let them go to vm. I'll check with county clerk periodically for any lawsuits and just move on with my life!

I really appreciate all the feedback and am so thankful that I have found this forum of fantastic people! Keep up the fight :)
