Help with payday loans in M.D. and my bank.

While I was living in M.D. a few years ago I took out some pdl's. I paid off most of then, which was a whole lot more than I borrowed of course. However there was one I didn't pay off, for one reason that's about the time I found out they were illegal in MD, also I didn't have the money to pay the outrageous interest they wanted. So first I tried to close my bank account at Wachovia, when they wouldn't close it I tried to get them to not allow any more ach withdrawls but they would not do that either, they said because there might be something out there waiting to go through, I went as high as I could talking to the manager, but he said same thing. So I did take all my money out of my account. Well needless to say that pdl tried to take their money, which overdrafted my account. The bank allowed them to keep doing this until my account was over $900 and some overdrawn then the bank closed my account theirself. Does anyone have any help they could offer? Cause that caused my credit score to go way down and I also can't even get a new bank account. Thanks in advance for any help.


Instead of trying to revoke ACH on your account, you could have asked the bank to put your account on 'deposit only' status. That would have kept the PDL from pushing the account into overdraft.

What you need to do now is go to the bank authority and ask them about the "something out there waiting to go through" and if it has gone through or not.

Why did the bank refuse to close the account or revoke ACH? Its your account and you have the right to modify or dissolve it at will.

The bank is of course going to ask you to pay off the overdraft and when you refuse, they are either going to seek a judgement against you or charge off the account and give it to the collectors. Your best bet is to file suit against the bank employees.

The problem is that you mishandled it in the beginning. The only avenue you may have now is to dispute those charges as fraudulent with the bank. If they prove to be fraudulent charges, the fees would also be reversed and that should eliminate the debt. You'll need to prove that you paid the principal of the loan and therefore owe nothing further.
