If they garnished your wages, unless it was a student loan, they got a judgement against you. Did you receive a summons? Answer it? Show up in court? We need more information.

It was an old Fingerhut account. Last I heard from those people was 1999. I was paying on it regularly then stopped getting bills. I never got served about the judgment. I never got served about the garnishment. I found something on my credit report a couple of years ago, but its been off for a long time now. I didn't speak to them today, I just turned the phone off. I hit ignore on my cell phone. Thats when they called my mom at her work. They told her I was being sued and that she needed to tell them how to contact me. They called my parents house a long time ago and told my Dad that there was a warrant out for me and that I was going to be arrested if I didn't call them.
My credit is clean now and everything is current. I shouldn't have to file bankruptcy or go to credit councelling, but should I to get rid of them? They have garnished my wages once so they know where I work. I don't even know how much I used to owe.

I didn't think to look at that until a couple of weeks ago. The judgement was from 2007. I look into it after I got the garnishment papers from my employer when I wanted to see why money was being taken out of my check. They had 3 garnishments against me for the same debt. 2 didn't work, the 3rd did. I didn't know about any of them until the 3rd went through. The court screwed up and sent my employer a letter saying the garnishment had been dropped and to return all money to me and not take any more. My company returned all the money to me and then they found out the checks they sent to the court had been cashed. I called the court and said "oops, sorry, you shouldn't have gotten that letter" and I had called that day to find out what the letter meant and got the reason from the clerks office and made sure it was right and we read it correctly, the guy said it was correct and read my file to me. The day I got the "oops" comment the clerks office said they made a mistake and the only way to fix it was to contact an attorney. Now I owe my job $400 and the garnishment could happen again. I have all the letters from the court saying it had been dismissed.

Statute of limitations in VA is 3 years. They obtained their judgment well after that 3 yr mark. I suggest you petition the courts to have the judgment set aside due to improper service. AND ensure you let them know that if you had been properly served, you could have used the defense that the debt was time barred. That may be precisely why you weren't served properly.

If the date they sued was after the SOL expired, you can likely have this overturned with prejudice.
