Over the past 2 years or so I have gotten into a horrible cycle of payday loans. Most of the time I am able to pay them back but recently im just barely getting by so I decided to research ways to get out of this cycle. While researching I found that internet or any type of payday loan in NC is illegal and contacted the Attorney Generals Office and I was told to shut down my bank accounts, pay the principle, and ask for a refund of overpayments. Now I just finished my first letter thanks to this forum and what is the likely hood that they will reimburse me for loans over the past 2 years? My total loan reimbursement for one particular company was well over 5k. Anyone had any luck with this in NC? I mean since its illegal they have to reimburse me right? Thanks for your help any advice is greatly appreciated.

My current lenders are:

Ameriloan
CashJar
USFastcash

that's nice steve, but the OP is in NC,not NY!both states totally prohibit pdl's,but that is the end of the similarities.

So far I have been contacted by 2 of the 3 lenders saying that they are reviewing my documentation and they will get back to me within 3-4 business days. I have logged into all 3 accounts and 2 are showing a zero balance, with no new due date, and it also states that the account status is unavailable at this time. The 3rd lender (Cashjar) just has under account status to contact them immediately.

So far so good, i'm hoping they will grant me the refunds owed to me as that would be a great deal of $$. Thanks again for your help guys.

After 3 emails I finally heard from CashJar today. They agreed to settle my account for $356.62 if I contacted them within 48 hours of the email. If not my account would be sold to a collection agency. I knew this was bogus thanks to this forum and called them immediately. Apparently my file was now in their collections department even though I havent defaulted on the loan b/c another transaction wasnt due to take place until another week. So the first customer service rep. in their collections department tried to argue with me over the fact that they operate under Belize law. I told her that Belize law doesn't apply to US law nor NC law. I said until she can get over that fact I still demand a refund. So after 30 minutes of back and forth and her obviously losing the argument she transferred me to her boss. Her boss comes on the phone and she says your case has been reviewed by our legal team and you have a $0 balance but we will not be refunding you any $. She went on to state that I was getting a great deal because I still owed them. I told her that her company was a joke and it was impossible for me to owe them anything when their contracts are illegal in the first place. So I told her im moving forward with the NC Attorney General, BBB, and FTC. Our conversation ended on that note but im going to keep fighting for the return of my overages.
