Help! Doomsday This Friday--California
Date: Wed, 04/25/2012 - 13:19
1) Cash Central---$300--Legal in California
2) Shoreline Online LLC -- $500 -- paid $150 to date
3) IPL Today -- $500 -- paid $150 to date
4) National Opportunities Unlimited, LLC -- $500 -- paid $150 to date
After reading some of these forums I called my bank yesterday and closed my account so no debits could be taken this Friday. They also put a hard block on my account and assured me that no link would be given t the new account they also opened for me. I need to contact Cash Central today I imagine as they are legal as I see a California address for them and want to stay in good standing.
My main concern now is, what is my next step in this process. I am afraid they will harass me at work and try to use a wage assignment..
Any information on how to proceed would be great. I just started a new job and want to remain in good standing and this is causing stress.
Update---
I sent the following email to the three internet providers that I could not find on California's payday lender site. As far as Cash Central, I emailed them and explained my account was "Hard Blocked" for my safety and I need to work out a new payment option for this Friday when loan is due.
Dear Lender,
It has come to my attention that payday loans are prohibited in my state unless the lender is LICENSED in my state of California. Therefore, the loan contract that I have with you, according to my state???s laws, is not LEGAL nor is it Enforceable. I believe that the best way to clear this up is please provide me Validation of your license that permits you to loan to California residents and that your fees are in line with California laws.
At this time I am revoking ACH authorization. You are no longer authorized to withdraw payments from my checking account. I am also revoking any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.
California law says that you must stop phoning me at home and at work once I ask you to. I am officially requesting that you not phone me at home or at work. If you need to communicate with me, then do it in writing or email. I am requesting this on this date, which is marked by sending of electronic email stamp.
If I find that you have defrauded me then I will be forced to contact my California State Attorney general and file a complaint along with contacting the FTC as well.
Thank you,

Just follow the instruction here. No need for such an elaborate letter. Moreover, illegal lenders are no required to provide you with validation of their license. It is up to you to find out if they are licensed or not. If you are unsure, just ask the California Department of Corporations.

Wells Fargo denies my dispute and pays illegal lenders
So I sent the above mentioned lenders in my previous posts many revocation letters, emailed copies of California State law, etc...
I had disputed the charges that went into my bank and put me overdrawn by $200. I explained in my dispute that these lenders were illegal in California and that I requested they cease and desist from any ACH from my account. I also explained to the Wells Fargo rep that I could be targeted for fraud if my account wasn't protected.
Its been like two weeks and I get a letter saying my dispute was denied and these accounts were being paid. I am so angry now because wells fargo denied my claim even though I took the proper steps like 3 days before ACH and they still let it go through, then when I noticed it and disputed it they denied me.
I then told wells fargo that these companies have now been given open season on my account because I cant cover overdrafts now and wells fargo will let more potential debits go through with these companies.
I also did receive an email from Shoreline that they would write off the debt due to lender indifference and as a courtesy to me but I couldn't loan again. But now wells fargo is going to give them access to my account again.
What do I do? Any suggestions?
Please Help!!
These are some of what I sent to lenders...

Dear Mr. Coleman,
We respect a consumer who researches the services to which he uses. With that being said when you applied for and agreed to the terms of the loan, it would have behooved you to read the complete contract you agreed to with Shoreline Online. You are a citizen of California, however the contract was not made in California. The contract was completed via the world wide web, the governing law (clearly outlined in your contract) which you agreed to by your legal e-signature are the laws of the jurisdiction in which the lender is located. When you spoke with Marcia on 04/06/12 at 4:44pm CST, she clearly outlined how the loan works and what the finance charges were, yet you still accepted the loan.
We would be willing to settle with you for the principle amount remaining on your account. We could initiate the debit to your account of $250 on your next due date of 05/11/12. If making one payment to pay off the principle isn???t possible for you, then another payoff arrangement may be available. Also, if we cannot withdraw directly from the checking account we can setup an alternate arrangement by money order instead. Please call to let us know how you would like to proceed and ask for me directly. If I am not available, then please request a supervisor. You can also reply to this email to let me know how you would like to proceed. Thank you.

Who is Required to Obtain a License Under the California Deferred Deposit Transaction Law?
Any person that offers, originates or makes a deferred deposit transaction, arranges a deferred deposit for a deferred deposit originator, acts as an agent for a deferred deposit originator, or assists a deferred deposit originator in the origination of a deferred deposit is required to obtain a license from the Department of Corporations.
Any person located in California, who plans to engage in the business of making deferred deposit transactions over the internet only to residents in other states, is also required to obtain a license from the Department of Corporations.
Any person located outside of California who plans to engage in the business of making deferred deposit transactions over the internet to residents in California and to residents in other states, is required to obtain a license from the Department of Corporations..
John, you did submit the application online and sought out our lenders services. You spoke to our processor Marcia, verified all of your information, and willingly accepted the loan. This is all documented. If you are disputing the legality of the loan, the lender respects that, but if you look into it with your state further you will find that you are still responsible for at least the principle amount that was deposited to your account. The lender is willing to make arrangements to have the principle amount repaid without any other charges, but we will need to come to a mutual agreement in order to do so. You borrowed $250 and the $75 that was processed on 4/27 was returned back to us this morning. If you do not wish us to withdraw the credit back from the account then we can discuss alternate arrangements by a money order. We would even be willing to split the $250 credit up into two payments if necessary. Once it is received, the account will be marked as paid in full and the application denied for any future lending. Please let me know how you would like to proceed. Thank you.

I never spoke with Marcia by phone, not once and not ever. Marcos, as a representative of a company providing illegal loans.to consumers in states such as mine, California you should not try to explain the law of my state California. And further more you and your company are defrauding consumers with illegal, false, and misleading statements. I do not owe the amount you say. But Marcos please provide a physical address so I can pass it along to my State Attorney General. I will not be bullied. You are part of a predatory lender scheme from overseas that scams unwitting consumers.
Mr. Coleman, I can assure you we are not part of any overseas fraud ring. Nor have we at any time tried to bully you or provide you with any misleading information. No one has tried to harass you at your home or work #, and the only contact we???ve had with you has been by email since 04/06/2012. We are merely trying to recover the $250 principle amount that was deposited to the account on 04/06/2012, which you at no time so far have denied receiving. Due to your dispute and complaint, but with no obligation to do so, the lender is writing off this account and denying the application from any future lending. You can provide the address below for any correspondence.

Did you give Wells a copy of the ACH revocations after you sent
Did you give Wells a copy of the ACH revocations after you sent them to the PDL's? Under federal, Reg E, they must comply. Sounds like you were arguing the wrong points with wells....they dont care that the lender is not licensed or illegal. However they will abide by an ACH revocation provided you supply it to them timely.
ACH Revocation Letter
No, I did not give them a copy of the revocation. It's my day off tomorrow and my first chore is to take that to Wells Fargo and hope it works..
Thank You for the advice...
