Today I received a voice mail message at work from someone at AdvanceMe Today saying he had a question on my "chat" with their representative. I never chatted with anyone from there, either on the phone or online.
I have sent them another e-mail stating that payday loans are illegal in NY and again asking for the refund.
I want to make sure that all communication with them is in writing, so should I send them an e-mail specifying that, or should I send them a C&D letter?

Ignore their Calls
You have told them everything you need to in writing. You can continue to ask for your refund in writing and persist, but they will continue to call you and probably use threats. Illegal lenders will ignore C&D letters, but send it so you have a record.
If you do happen to talk to someone, ask for a physical address and for a letter of debt via postal mail. They usually hang up on me when I ask for that information.
I have been dealing with a similar company, and they ignore your requests. It's best to hang up on them, or don't answer. My favorite thing to do is to pick up and then immediately hang up, then they can't leave a voice mail either. they will try everything to get you to pay, so if you talk to them at all, it encourages them to keep calling. They have threatened court on me 6 times, and even had fake process servers call saying they are serving me in 2 hours. I can't believe they actually leave this junk on my voice mail where I have a permanent record of their harassment.
If you ignore them... Eventually, they give up.
I have yet to get a refund from the 2 loans I overpaid. One of them quietly went away and the other is still trying to call me 3 months later. I don't expect to ever see the refunds, but getting the harassing bottom feeders off my case is reward in itself.
Make sure you file complaints with the FTC and AG.

to the OP.if you are gonna press for refunds do not email the C&D as there is no partial C&D.it's all or nothing.now you can include this in your refund request.
while i perfer to communicate by email only any future calls accepted by me will be recorded for my records.
include that knowing that sending a C&D and then emailing a refund request doesn't give the greatest of impressions.
