Does the 30 day rule still apply if the respond but say the are still investigating? Or do they have 30 days total to have a resolution? I sent a letter on April 6th 2012 and still no response except the acknowledging the receipt of the dispute, dated April 7th and then a letter on April 23rd saying they are still investigating. Can and should I still send the demand for removal letter? And do you have a good template for this?

You should wait around for the full 30 days and then follow up with an enquiry asking about the status of the investigation. Once you have confirmation and their report on the investigation, you can then send in your request (although I think they would delete it the moment they find out its a mistake).
