Payday loan in ca

I got a payday oan via internet and paid half back and closed my account and offered to pay in payments thet refused and now they say they will garnish my wages. Can they do this without taking me to court first?


No they can???t do that. At first you should find out whether or not the pdl company is licensed in your state. If they are not licensed, then they won???t be able to take any legal action against you. But if they are licensed, they can sue you because of non-payment of debt. Once the court issues an order against you, then they can garnish your wages. But they can???t do anything without a court order.

the two above me can't see the OP is in CA(california)i have a few questions.

1)who is the lender
2)how much was borrowed
3)how much was paid(debited)before default
4)internet,or storefront

please provide the info requested.it will help us help you.btw the one thing either got right is the fact that they would have to sue in your county,town,village,or bourough and win to garnish.
