Drowning in PDL's/Installment loans
Date: Mon, 05/14/2012 - 22:31

ChecknGo - installment for $2600 & I've paid $4264
Great Plains Ledning - installment for $1000 but i've paid $2514.16 on current and past loans
Advance Me Today - PDL open bal $1000 but i've paid $3658.86 on $2300 borrowed on multiple loans
247 Green Street - PDL open bal $1100 but i've paid $9463.31 on $8795 borrowed on multiple loans
My checking account has a negative balance, and i called checkngo to see if i could revoke my ach and they said that i could not revoke it based on the agreement i signed. I'm going to contact the rest of the lenders tomorrow to revoke my ACH. Is it better to email them or should i call them? I also called my credit union, and they said it's difficult for them to revoke ach's from their end because lenders can change their codes/names? and submit withdrawals. I'd hate to close my account, but i may have to. I had to move out of my apt because i can't afford my rent and am now crashing on a friends couch. More than half of my monthly income is now going to payoff these loans and i don't know what else to do. My next paycheck isn't until the May 25th and my whole paycheck will go to payday loans. How can i tell if these lenders are licensed in California? Any suggetions will be greatly appreciated.
Plain Green is illegal in most of the state of US. To know more
Plain Green is illegal in most of the state of US. To know more about the other pdl companies, you should contact with California Department of Corporations. If they are not licensed, then you are required to pay them only the principal amount. Ask them for the refund, as you have overpaid them. Close your bank account asap to stop unauthorized withdrawal. Look at this page to know about how to deal with illegal lenders:

Plain Green - Illegal tribal lender, they owe you $83.53
ChecknGo - Legal. You need to work out an extended repayment plant with them.
Great Plains Lending - Illegal tribal lender. I can't tell you about past loans but you are entitled to a refund of the amount you overpaid over and above the principal amount you borrowed.
AdvanceMeToday - Illegal offshore lender. They owe you $1358.86
24/7 Green Street - Illegal. They owe you $668.31
Don't forget to file complaints with the AG and the FTC against those illegal lenders.
Check N go
Check n Go won't work out a payment plan for your installment loan until you default. Then you can work with their collections department and settle the loan.
It looks like to me that Check N Go has been paid more than what

One down and few more to go
So i sent emails to all of the illegal lenders I owe and i got a response from Plain Green below. I haven't heard from any of the other lenders. Should i resend the emails? I already closed my bank account.
Your correspondence has been directed to me for review.
We are sorry you are not satisfied with your Plain Green Loan. After reviewing your account history, we are willing to consider the account paid in full and will close your account from further activity.
To further clarity your questions regarding the legality of this loan, Plain Green is organized under the laws of the Chippewa-Cree Tribe of the Rocky Boy???s Indian Reservation of Montana (???Chippewa-Cree???). Plain Green is owned by the Chippewa-Cree, and operates exclusively on land owned by the Chippewa-Cree. As such, Plain Green stands as an ???Arm of the Tribe,??? in the view of the United States
state and federal courts. Therefore, loans made by an arm of a sovereign Indian nation are not subject to state law. This is NOT a payday loan.
This letter is written to help you understand that Plain Green and its loan contracts are governed exclusively by the laws of the Chippewa-Cree.
Pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.
If you would like to contact me directly, please feel free to do so at extension 2739. If I do not hear from you, I will consider this matter closed.
Thank you again for your time and consideration.
Advance me today response
So i got a response from from Advance Me Today. What should i do? They didn't really tell me if my ach has been revoked or my loan considered paid in full. Should i respond back?
Thank you for contacting us.
Please be aware that this is a St. Vincent company, St Vincent and the United States are
both parties to the General Agreement on Trade in Services, a treaty which specifically
permits companies in one country to make consumer loans to citizens of the other.
Under the treaty, we are only obligated to follow the federal laws of the United States.
We are not required to obtain state licenses and individual state laws do not apply since
the federal laws adopting this treaty supersede any state's laws on the subject.

Don't fall for all that BS. Indian laws don't apply to you just
Don't fall for all that BS. Indian laws don't apply to you just like Federal Laws don't apply to tribal lenders. All that 'Arm of the tribe' talk is pure tripe. Just ask them to refund you or you will file complaints with the AG and the FTC and bug them till they relent to paying you.
The same goes in case of AdvanceMeToday. The laws of St. Vincent don't apply to you and tell them in writing that you are going to file complaints with the AG and the FTC unless you are refunded immediately.
Best of luck,
Nate
Progress-whew!

I just rcvd this response:
As per the loan agreement included in our prior correspondence, Northway Financial
Corporation Ltd. is a Financial Institution licensed and regulated in accordance with the European Union (EU) Directives. Therefore the laws of the Republic of Malta (member State of the European Union), apply to the terms of your loan. The same would be true if you were to borrow funds from a financial institution in another state in America other than the state of California. The laws governing financial institutions in that particular state would apply to the terms of your loan.
As stated in our last letter, we are unable to issue a reimbursement for previous loan fees.
I filed a complaint w/ CA dept of Corporations, but has anyone had any luck working with 247? They're not giving in. There's already a D&R filed against them in CA and that hasn't worked!

help. very concerned, depressed.
I'm getting ready to default on 2 loans, cashnetusa and Checkngo. I've paid cashnet more than 2600 for 2500 loan. Checkngo I've only paid 900 for 2500 loan. Im going through very difficult time right now, can't eat, sleep or concentrate at work. I plan to shortly email loan companies to advise I'm unable to pay. I never thought in my life I would find myself in situation like this.
Has anyone had good experience with collection dept. for these loans? I'm going to provide them best email and number to get hold of me so I can discuss settlement options if possible and let them know I'm trying to pay what I can. Have they been helpful in these circumstances. Any ideas what would be good settlement offer I can give? I appreciate all your help. Also, if they do agree as to settlement, should I ask for something in writing first then begin sending my payments? God bless.
Drowning in PDL's/Installment Loans
Can you tell me when you said Check N Go settled for 50% of the balance due. Did they set up monthly payments in order for you to pay that? Thank you.
Epp
I dealt w/collection dept and they were very helpful. They gave me a few payment options and the 50% settlement was the option that worked best for me. I settled for $415/mth for 2 months.
Hang in there. I know it seems overwhelming but you just have to take it one day at a time.
Good luck!
Checkngo Collections
Thank you so much. Did you find checkngo might be helpful in terms of offering them lump sum settlement amount? Did you wait a while to see if collections might be able to accept or did you reach agreement after months of negotiation?
