If the debt is 8 years old can they still file a 1099c?


what state are you in,and are you sure about the debt being eight years old.you see as soaplady stated it goes by date of last payment.also the debt matters as well.the SOL can figure in here,but we need the info requested before we can advise further.

I am in PA. It was s store cc. I haven't given them a payment in over 9 years. I stopped receiving calls and letters from them years ago. This year I pulled my credit report and paid off all that was on my report. They were not on there or I would have paid them. However when I told them I needed 2 days to research the 1099c the woman told me that I was refusing to pay and she hung up. I called back and got another Rep and she got nasty with me when I asked her to give me 2 days to research.

there is no SOL more than 6yrs in PA so whoever said that needs to be reported to your state AG asap.do not pay them it is past SOL,and if they issue a 1099c you can file a dispute with the IRS.however i'm guessing this is a bottomfeeder that is calling as the threat of a 1099c on a time barred debt is borderline illegal if not totally illegal.
