I don't have the date of the last payment to a creditor (Capital One) to know when the statute of limitations will be up. We had entered into a debt consolidation company that went bankrupt and so I have no way of contacting them to get the paperwork that we had given them. I did send a debt validation letter to the last 2 companies that had bought the debt but got no response. LVNV funding is saying that it is 2008 on my husbands credit report but no one in my home reaffirmed that debt. I'd like it removed from his credit. Any ideas?

You should be able to tell from the credit report when the last payment to Cap One was. If cap one no longer appears, the debt is more than likely out of SOL.
