:confused:Here is my question. What if the payday loan has already sold your account to a collection agency and they don't want to give me their address where I can send in payments?

The lender is an online lender. I tried checking them online under the Div. of Finance in our state and they are not listed. So I am assuming they are illegal. They already sold my account to a collection agency. I borrowed $300 of which I have made 2 payments fo $90.00 for finance fee. I tried to talk to the agency but they are not willing to work with me regarding the payment. They want more than what I can afford. They are threating me saying they will have a law suit. I even asked for their address, but they are not willing to give it to me.

Who is the collection agency?? You need to send them a letter telling them you will pay ONLY the remaining $120 that you owe on the illegal loan and that you wish no further communication from the them.

CA's cant sue...they are not attornies and do not have the legal capcity. And even they attempted to sue you, you have the defense that the loan is illegal in your state and is not enforceable.

this sounds like complete bottomfeeder.if they want to threaten(which stating they will sue is a threat)then use the number and name to report them to your state AG.btw i do want t know who the illegal is just for our info.

The Debt Collector is violating the FDCPA by not providing you with an address to where you can send correspondence. How ever if they provide you with a P.O. Box or a Suite #### address they are within the FDCPA guidelines for providing the address.
