I have to go to the courthouse today or tomorrow to fill out some paperwork concerning this case. Anyone who could help advise, it would be greatly appreciated.

The first concern I had is that they delivered this to a house where I no longer reside and they left the paperwork there. It happens to be my mother's house, so I'm not going to argue that point. One of the moderators on here said they would just turn around and serve me again with my real address. So that is a moot point.

The second thing is that before I was served I received NO notification from this collection agency/law firm. I never received the chance to do debt validation. Is there someway I can mention this at the courthouse? How do I bring that up? I would have sent them a debt validation letter as I have the other agencies that had this case.

The papers "I" was served with at my mother's house said that I am being given the opportunity to come down and explain my financial situation in writing. I am certainly a hardship case. There is no doubt about that. I'm not one to shun my responsibilities. I don't make enough money to live off of most of the time.

Please someone tell me how to handle the fact this was the first communication I received from the company. I had never heard from them before. How can I go about asking for debt validation?


Their is no legal requirement that they must first contact you prior to taking legal action. However, you still have the right to request debt verification under FDCPA 809(a).
Show up in court, and request they first provide debt verification.
The judge will most likely place a continuance on the action until they have complied.
