1. Magnum- Paid off through scheduled payments. Excellent
2. CashNetUSA- $2008- They say I have to pay it down. $415 PP
3. First America Credit-$1450. Same thing. $165PP
4. Idealgelt-$1000. Same Thing. $350 PP
5. Discount Advances Same Thing. $248 PP
6. PayDay Advance- No Answer Yet $60PP Have to pay as a whole $400
7. Greenlight Funding-No Answer Yet $160 PP A little of principle each pay.
I know I owe these folks but I really need to just get an cheaper payment so that I can pay my bills. I am filing chapter 7 next month and I am changing my direct deposits and closing my bank account after 2 more items clear this month. I will be changing my ACH for Car Insurance and Home Insurance by the end of the week. Can you please tell me if any of these companies are illegal in Maryland and if I close my accounts, can they sue me? I don't want to put them in the bankruptcy but if I have to I will..

Payday loans are illegal in Maryland. I believe the only legal one is CashNetUSA as they are a CSO (this may no longer be true). You are heading in the right direction of closing your bank account. You may also want to contact the Maryland Commission of Financial Regulation, 500 North Calvert Street, Room 402, Baltimore, MD 21202, (410) 230-6100. They are a great help in dealing with illegal lenders along with this great site. I know there is a link on how to deal with the illegal ones. One of our moderators will give you that link. I hope that you are not declaring bankruptcy because of the payday loans. You are only morally obligated to pay back the original amount borrowed. If paid back more than the principal, then you can request a refund. Good luck!:o

Cashnet is legal but they really don't want to give me a set repayment plan. Will have to bug them I guess.:rolleyes:

When you do transactions on our website, you are agreeing to abide by the rules and regulations of Costa Rica, where we are incorporated. Regardless, you have been with us as a good client and I am willing to close out your account. Your account with us would still show a balance owed of $400, but your file will stay in our office and no collection action of any kind will occur.
I wrote this back:
That is fine but my attorney is saying he needs an address, phone number and account number to provide to the courts. He is telling me this email is okay, but that you may come back after bankruptcy is discharged.... He is also stating that I have overpaid on this PDL and should be due a refund.

According to my attorney, I need to send a cease and desist letter because you are not authorized to make payday loans to Marylanders and you are not registered with the State of Maryland. Please confirm and if you can show us your are registered, please send me information. If not, please send an email showing the account is paid in full. If you are, I can pay off the principal in 1 payment. I will be using my Paypal account until I am able to open a new bank account. I show I owe maybe $252. If so, I can pay that on 6/11 using my Paypal account.

Now, I know I owe Greenlight $252 of a $400 dollar principal. I only paid them $148. Should I go ahead and send that in?

No response from the rest yet. CashAdvanceUSA says they will get with me soon. I guess they are waiting until I miss a payment then send it to collections.
