am attorneys office just contacted me on a paydayloan that I had about a year ago.adgo stop paying them because they were taking too mich out of my check.so I changed my bank account andy closed the old one and now they are ttrying to threaten. me by sending the sherrif to my job or to my home what shall I do?


how about reporting them to your sheriff,or police as they broke the law.use the name and phone number.then ignore them,and don't worry about lawbreaking slime.

right now nate i want them to report this piece of garbage that broke the law with their threats.as threatening arrest is a threat,and an illegal one.it's obvious that whoever the lender is(if there even is a lender)sold the debt to a bottomfeeder.let's advise on how to handle the lawbreaking slime first.

Not so fast, Paul....

This doesnt mean that they threatened to arrest the OP....If you sued someone, you would send the sheriff to them at their home or work to serve them with papers. Unless they actually said that they would have him arrested, this isnt the proper advice.....and the OP never told us that they made that statement. Many jurisdictions use the sheriff's department to serve papers instead of process servers.

point taken skydiver,but given this is a pdl.i'm going with the arrest threat,but that's JMHO.btw you really think this law firm already filed suit?i again doubt it as the phrase "scare tactic" comes to mind.again JMHO.

I understand the scare tactics, but the point is this--without more info, it is premature to tell the OP to go to the police. We simply do not know enough for that advice yet. What if their scare tactic was to say "we are suing you unless you pay"? that isnt a matter for police, it's an FDCPA issue strictly, which makes it a civil issue, not one for involving police. We know that these clowns use scare tactics, but we cannot jump the gun on our advice without knowing which tactic they are using....

I am sorry if I get kicked off and right now I just want to be deleted. There are some people on here giving some back advice. I do not know what these cc points are, if anyone is getting paid, etc. but seems some people are just copying and pasting and saying do this and that. Then they get mad when you ask questions and state your posts are too long. No all online PDLs are illegal. And not all states regulate them. I live in Louisiana and they have very strict payday loan laws. But I spoke directly with the attorney general, secretary of state, and the director of the office of financial institutions. They directly told me that unless a payday loan company has a physical presence in the state, they do not regulate them and they do not have to follow Louisiana laws. They do have to be registered in the state they do business in. So after the advice that seems to keep getting posted--send ACH revoke, etc. because all online payday loans are illegal, they must be registered in your state, etc. Finally a couple stated that one of my lenders was a cso. Still confused on that one because they are a cso in Texas and Ohio no in Louisiana but they are still registered in Delaware, the state my loan came from so I am liable. Now I have to deal with them. I have been checking into the other companies. If I didn't find them registered, I contacted the offices in their states to see. I have received a couple of responses very quickly and know two of them are not legal which are the tribal lenders (which I was sure of already) but wanted my bases covered. I have documents from those states as proof. Am waiting on some others. So people do not need to jump the gun and say all online PDL lenders are illegal. They are not and they may not be in your state. Just because a state has payday loan laws, doesn't mean they pertain to online companies.
