I have several payday loans. Got into some financial trouble and got desperate. Not my proudest moment, but now they are killing me. My questions are,

1) If I had a loan with usfastcash for $300 and paid it off, and received a new one. I ended up paying around $700+ for the $300 loan. Should I still pay off this new loan which is for $400 or consider it paid in full and tell them that, since i believe thay are illegal and I already paid so much?

2) I am already in chapter 13 and these loans were obtained afterwards, again, emergency situation called for it. Does that matter? I just don;t want something to come back and bite me.

Rejoice! I come bearing good news :D

All the theatrics aside, USAFastCash is an illegal tribal entity and loans originated by them are illegal as well. In case of illegal payday loans you would just need to pay off the principal amount that you had borrowed ($300), no interest, fees or other charges.

Here is a DIY guide to dealing with illegal PDLs: www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html

Good luck :)

P.S: Bankruptcy doesn't affect the situation or come into play anyhow, especially since you got the loans after filing.

Thanks Nathaniel. One other question. I went in ad closed my checking account and opened up a new one. It is with the same bank, but they do not link accounts without written permission and also an ACH will not reipem the old account.

Here is where I made my stupid, stupid error. One of my pdl's, EZPAYDAYCaSh, was almost paid off. Honestly, they had been pretty easy and good to work with for me anyway. I, without even thinking about it gave them my new account info to payoff the loan. Can they now give that info out to other pdl's?

Thanks
