I got a letter from them about a debt I owe of 466 (somewhere around there) which is via Speedy Cash. This last month I then started getting automated calls daily or every other day from Ad Astra.

The original amount of the payday loan was 400. I paid back (around 330), but I remember I sent them a cease and desist from taking money out my account because I wanted to deal with money orders and they withdrew money anyway which overdrafted me and brought my total payments made to around 380 (still owed 200 for interest).

I just want to get this taken care of and it has been over 2 years now so I don't remember the exact amounts I paid. I sent them (ad astra) a debt validation letter along with a cease and desist of phone calls, automated phone calls, and phone calls to my friends/family.

I sent it certified and they signed for it on Monday. On Tuesday and today (Wednesday) I got calls and voicemails from their automated system again about how they are trying to collect a debt.

What is my next step? Just wait for the letter they send back or complain about the calls to my AG/FTC? When is taking them to court for violating my rights an option?

I googled them with how they respond to debt validation letters and saw they do not send payment history just a letter saying they have the debt, and you owe this much. I want to actually see a breakdown of what I owe since I cannot access my old bank statements online anymore. (I had to switch banks thanks to payday loans over drafting me).


I am in IL and it was via the internet. I cannot remember if it was a payday loan or an installment loan, but I just read on the IL Attorney General website that the monthly payments on installment loans cannot exceed 22.5% of what I make a month, and back then the payment did exceed 22.5% of what I made a month.
"Illinois prohibits lenders from issuing a loan if the monthly payments would exceed 22.5 percent of the borrower's gross monthly income."

i answered this on another thread.they are not registered as a pdl,or CSO so file an AG complaint against speedy cash,and i would look into legal action against this ad astra.being as speedy is not legal in IL you only owe the principle and any fee debits get deducted from that.meaning you might only owe like 100.00 maybe.also ad astra is not licensed in IL either(a requirement for collectors)you sent a C&D and they are violating it by calling like they are.since you have the address in KS(seems another bottomfeeder haven)resend the C&D with an intent to sue in there.

file AG complaints against both parties.then dispute it and include the fact that it is an illegal debt,and you filed AG complaints.i had two entries deleted that way both from bottomfeeders similar to this one.

Thanks! Just a couple of more questions, I thought I read that if I file AG complaint against the collection agency then I cannot file a claim against them in court for continuing to call me after receiving the Cease and Desist letter?
They called again last night making it 3 phone calls since accepting my letter. I am guessing they will call every day because the calls have been coming in once a day at almost the exact same time everyday.
I just always let it go to voicemail and I am saving all the voicemails.

I remember when I sent out a letter a couple of years ago to my AG about another payday loan company that is not legal in IL that they sent me back a letter asking for my original contract, and all the amounts paid on the loan. I do not have that information this time.
If I contact Speedy Cash is there a way or letter that will have them mail me my contract and payments made? I looked through my email and I have some 'payment received' emails but not all. I also think this was my 2nd or 3rd loan with Speedy Cash, the first 2 or 3 I overpaid so I want to get a copy of those also to see how much I overpaid on them.

With another illegal payday loan company once I proved I overpaid on previous illegal loans they marked my current one (which I owed money on still) paid in full so I am hoping since I was around $30 short of paying back the original amount that my over payments from previous loans with them will cover that.

when i filed(but that was in 2007)all i needed was the pdl co info,and bank statements confirming what was paid.you can try contacting speedy cash,but most likely they sold it astra.meaning they are not gonna most likely provide the contract.try to get bank statements showing how much was paid to spedy cash.as far as the AG and lawsuits.i never heard of that.

Thanks again! I went to Chase and paid $6 per statement (ouch) and totaled everything up and on the 400.00 payday loan with Speedy Cash I paid 400.40

Thank goodness. Now I don't even have to worry about trying using over payments to cover that last initial loan. Sending out my letters to the AG tomorrow. Hopefully, all will go smoothly and I can get Ad Astra off my back, get it deleted from my credit report, and definitely looking into taking them to court for repeatedly calling me after they signed for my cease and desist.

I was hoping someone could answer this for me. About a week and a half after Ad Astra got my Debt validation letter and C&D all daily phone calls stopped. I am still waiting for a debt validation letter response from them. (It will be 30 days next week)

Give or take 7 days after their daily phone calls stopped I started getting daily phone calls from ANOTHER collection agency. Can Ad Astra legally sell my debt after they get my debt validation request letter (and never respond to it)? Should I send this new company a C&D / Debt validation letter?

yes it is.as long as they don't attempt contact,or collections after receiving your DV/C&D.get the address of this new bottomfeeder and send them the same letter you sent to astral.again send it CMRRR.

I got the debt validation letter from Ad Astra today and I am really confused.
Loan amount: 247.71
Loan Fees: 0.00
Return Fees: 0.00
Current Balance: 379.09
Date of Loan: 2/4/2010
Date of Default: 4/28/2010

Then at the bottom it says: The Credit repairs organizations act bars any person from making or counseling any consumer to make any untrue or misleading statement whose intended effect is to alter consumer's identification to hide accurate credit information yadda yadda.

Here is my question. I took out two loans from them. The one taken out on 2/4/2010 was 100% paid back fees and all. It was another one that I defaulted on. Since they are claiming it was the loan taken out on 2/4/10 that is being reported on my credit report can I attempt to get it taken off since I have the records of me making all the payments via bank statements or do both loans roll into one? I took the second one out maybe a week or two weeks after I paid the first one off.

I asked them for my payment history and to tell me how they came up with the amount I owe, but they ignored that request and said every thing is legit, and correct and that I owe 379.09 and that it will still be reported on my credit report.

The 379.09 still makes no sense because I paid just over 400.00 on a 400.00 loan.
