Being sued by Michael J Scott for Capital One Debt
Date: Mon, 06/11/2012 - 14:54
Can anyone provide me some suggestions on what I should do?
I just received some documents in the mail from Michael J. Scott, PC regarding a debt that is exactly 3 years past due. The documents are to inform me that I am being sued in civil court for a past due Capital One balance. He has attached what he claims to be the actual lawsuit that has been filed against me.
In this letter, he states that it is not too late to settle the matter, and that they could give me a discount for lump sum payment if paid now, or that I can choose from a variety of payment plans. In addition he has some court documents attached to the letter, and then a list of requests/questionaire of some sort asking me to accept or deny each request (i.e...this is my debt-Accept or Deny, the balance shown is what is past due-Accept or Deny...). He states that I am not required to answer, but if I don't that I will be served papers.
I have been reading other posts regarding Michael J Scott and have read about a debt verification letter. What exactly is this? Can anyone help me with what I should do?

Once you have received a summons, it is too late for a DV. Quit
Once you have received a summons, it is too late for a DV. Quite frankly with cap one as a client, it is a waste of time....you can call cap one to verify placement and lawsuit approval.
You can also look up the case online on your county court website.
Cap One usually gets their judgments, so right now I would be more concerned with settling it ASAP.
