A little nervous... Can they garnish my wages?
Date: Wed, 06/13/2012 - 13:55
I took out a payday loan with Western Sky/Cash Call. Biggest mistake EVER!!!
I have closed my account and someone called and threatened that they have started proceedings to garnish my wages. I heard in PA that they cannot garnish wages. What if they have a judgement? Can they garnish it then? Does PA even allow judgements to be issued for a payday loan?
Another thing is I live in PA (Philly to be exact), my workplace is in NJ, and my company's corporate office is in Arkansas. Is the wage garnishment laws regulated by the state you live in OR the state your company is in?
Any help anyone can give me would be highly appreciated. I just need to know what to do with these people. I want to pay the principal but they don't want to hear it. They frustrated me so much, I don't feel like paying anything else at all!!!
Thanks in advance

Garnishment laws are regulated by the state you live in, not the state your employer is based in. Moreover, these nutjobs can't get a judgement against you simply because their has has to legally valid which it can't be in this case because payday lending is illegal in PA.

Thanks a lot!!!
That makes me feel much better and breathe a sigh of relief.
I don't know how long they will continue to stalk me though.
I get at least 8 to 10 calls a day!!!
I guess I'll ignore them as much as possible until the "heat" dies down and they give up (hopefully they do or I may have to change my #)
Thanks again for your answer!
One thing extra make sure you send both Western Sky and your HR
One thing extra make sure you send both Western Sky and your HR a revocation of any wage assessment that might have been part of the contract.
another point
do as tousi76 advised as while PA is non-garnishment some HR people are stupid enough to honor wage assignments even in non-garnishment states.get the revocation letter to your HR/payroll person before sending it to western sky.
