HELP! being sued over payday loans not legal in CA

I sent letters to the payday loan companies that I found here on the website and 1 company sent a response stating my loan was paid in full. Another company contacted me and was sueing me and taking me to court, since it was $250 I went ahead and paid that amount since I couldn't afford an attorney or court fees.

Today I just received an email, I"m not sure which company yet stating that they're going to take me to court and sue me, and place my SSN# on hold. I'm not sure what to do now. Do I contact a lawyer in my area now?
I sent a couple emails to the companies I never heard back from stating that I wanted an email stating my account was paid in full but I never received anything from them. HELP! I'm so stressed over this now :confused:


The one that I was being sued for last month was Mass Street Group. I was contacted by their recovery group and then I was contacted by a local company here that was going to serve me the papers. That one I went ahead and paid. I told them that it was illegal and they said that I signed the contract.
Should I contact a lawyer in my area??

Here's the email I received today and I emailed back asking for more details and which company. I'm still waiting for a response:
You are going to be legally prosecuted in the Court House within couple of days. Your SSN is put on hold by US Government, so before something goes wrong we would like to notify you about this matter. It seems apparent that you have chosen to ignore all our efforts to contact you in order to resolve your debt with Payday Services. At this point you have made your intentions clear and leave us no choice but to protect our interest in this matter.

UNITED LEGAL INVESTIGATION BUREAU HAS STATED 4 SERIOUS ALLEGATIONS AGAINST YOU AND THEY ARE:

(1) VIOLATION OF FEDERAL BANKING REGULATION
(2) COLLATERAL CHECK FRAUD
(3) THEFT BY DECEPTION
(4) AND THE BIGGEST ONE IS E.F.T. THAT IS ELECTRONIC FUND TRANSFER


Now, this means few things for you. If you are under any state probation or payroll we need you to inform your superior or manager what you have done in the past and what would be the consequences once the case has been downloaded and executed in your name. If we do not hear from you within 48 hours of the date on this letter, we will be compelled to seek legal representation from our in-house attorney. We reserve the right to commence litigation for intent to commit wire fraud under the pretense of refusing to repay a debt committed to, by use of the internet. In addition we reserve the right to seek recovery for the balance due, as well as legal fees and any court cost incurred.

WE HAVE ALL THE RIGHTS RESERVED TO INFORM TO FBI, FTC, YOUR EMPLOYER AND BANK ABOUT FRAUD.

And once you found guilty into the court house than you have to bear the entire cost for this law suit $4271.15 which is excluding loan amount, attorney's fees, and the interest charges. You have the right to hire an attorney. If you don't have one or if you can't afford then one will be appointed to you. We believe that this was not your intent and that these steps are unnecessary. We merely require you to contact our recovery asset location department at +1-716.941.7540 between 9.30 to 6.30 (EST).

that email is generated from INDIA,and a total scam.a couple of things.

1)the EFTA states that ACH'S can be revoked at anytime.so how is exercising your rights illegal.
2)payday services is affiliated with paydayloan yes and not based in the US.
3)just what is a united states of attorney.

i would forward that piece of illegal stupidity the the FTC.go to www.ftc.gov do that and keep doing that knowing that email is total BS.none of what the scamming turds put in there will happen.

Ok good I don't know I didn't search the name he gave me online before posting but online it states it as a scam.......just like the phone call scams.

But in the case with Mass Street Group where I was being sued and was going to be served papers. How would I have handled that if I didn't pay them and ended up going to court???? I still haven't heard from the other companies. Green Plain loans emailed and said my acct is paid in full....of course they never sent me the amount I overpaid. I'm just glad that's 1 less company to deal with

This is all BS. My favorite is the 4th allegation of EFT. Electronic funds transfers happen all day every day and they are in a no way "allegations." Again, this makes no sense. They're trying to use a bunch of legal-sounding words in order to scare you into giving them your money. Don't do it.

Hmm, how do they know how much the suit will cost? Attorneys are paid by how many hours they bill, among other things. How do they know in advance how much, to the penny, this law suit will cost?

OK, first off, what you need to do is contact the California Dept. of Corporations (you can do this off the Cal.Gov site) and FILE A COMPLAINT!!!!!!!!! It states in California Payday loan laws that you will NOT be prosecuted for defaulting on a loan. You can file a complaint for free and trust me, they will do the work for you.
These con artists are counting on the fact that you don't know the laws so you will get scared and pay up. And "putting your SSN on hold???" WTH??? Wow...Bottom line, not another dime, OK?:p

interest rates are illegal on payday loans. so it won't hold up in court.. only a handful of states allow them to be sued on so. mostly its just threats. if its a 716 number don't call back. or call back and scare the person who answers the phone.. ask why your atourney says you cannot be sued in a civil court in your state for a pay day loan and watch them stutter and back track and never call you again. :D

Ok thank you!

Now I just received another email from a real debt collector on another payday loan I took out and had sent them an email stating that they're contract is void since it's not legal in CA. It's from Multisource loan.com and they're going thru Lighthouse recovery assoc, llc. Do I need to file a complait with my attorney general's office and the FTC?? What else should I do?? I haven't contacted them. I've overpaid them but now they're saying I owe $429.00 more......:(

yes file the AG,AND FTC complaints against both lighthouse and the lender.btw it's very rare that an illegal does take someone to court,but it does happen.the reason they don't is that all you would have to do is show the fact that the lender is not licensed.it gets dismissed and you leave the courtroom paying squat,bupkiss,nothing.again no pdl wants to risk paying a lawyer to sue and have it dismissed as it will be.just know that.

Rinse and repeat.

Yes, file complaints.

Tell them that you do not owe anything and that, in fact, the lender owes you a refund of the overpayment. Inform them that you've filed complaints against them with the SAG and the FTC and tell them to cease and desist any further contact with you.

Thank you! I've reported the PDL companies with both and the Attorney General just replied back and suggested that I also file complaints with Dept of Corporations and if I need to get money back than I need to consult an attorney. So not sure what I'm going to do about that since I haven't received any refunds for my overpayments. :confused:
