I won't get a refund, but the loan is going away! Persistence pays off! Keep at them and hold your ground. I got this today.

As we have explained to you on numerous occasions, you are not entitled to a refund. Your husband???s loan is legal and valid. It is not a payday loan. Your husband currently owes $2,634.19. Nonetheless, in light of your husband???s excellent repayment history, we are willing to settle this account for the amount your husband has already paid. Once you agree to this, we will send your husband a cancelled promissory note and report the loan as paid in full. We have responded to numerous e-mails and complaints and will not respond again on the question of whether the loan was valid. We will be happy to address any other concerns you may have. Please feel free to call me at any time.

I had a Cash Call loan at one time, as well. I was paying almost 50% on the loan. However, everytime I made a payment, the balance seemed to increase, NOT decrease. Anyway..to make a long story short, I did alot of research on them and found out they ARE illegal. They are NOT backed up by a bank as they advertise. They have several lawsuits aqainst them. I also found out if someone had taken a loan out with Western Sky and Cash Call took it over, the contract is no longer legal (in my state, anyway). I live in Pennsylvania. yes,..Cash Call threatened everything under the sun!! However,...I never paid them another dime.

That is great they are willing to accept you loan as PIF, however if you don't mind me putting my 2 cents in, I would not give up the chance of getting a refund back. From the way their response is worded they are not going to consider your account as being paid off unless you agree to not ask for a refund. YOu might want to put it in writing that you will accept their terms unless a future lawsuit allows you to receive any amount that you paid over the principal. Just my opinion. Maybe someone else can give you some advise on this.

When you stopped paying the loan did it start to mess with your credit report? I'm still dealing with Western Sky/Cash call, and I'm still paying because they do report...

Hi, there. I also have a loan with Western Sky/Cash Call - this is actually my second loan (not knowing they are not suppose to be lending funds to NJ residents as NJ prohibits PDLs). I paid off the first loan with interests ($2600 plus about $600 in interests). My second loan has not been in default (they will start taking out $295 starting the end of July.

I guess my question is, since they are not suppose to operate in NJ, can they file lawsuit against me and demand I pay them back, or worst, can they garnish my checks? Can I demand that they show me a license where they are legal to operate in NJ and if they can't produce one, ignore their threats and phone calls?

Thanks so much. This forum has been my anxiety/depression pills and has calmed me down with this PDL nightmares!

Soap lady,

I appreciate your advice and would suggest everyone utilize it. I will send them email saying exactly that (future lawsuit)! You have not steered me wrong!
