I live in Houston and I was just served last night with a lawsuit from this Michael J Scott on behalf of Discover. I don't recall receiving anything in writing from him but have received automated phone calls from his office. Is it too late to send a certified DV letter asking for verification? If it's too late, what are my other options?

Respond to the summons, show up in court and ask for validation during discovery. Do you believe the amounts are incorrect or that you don't owe the debt?
If you know it's valid and the amounts are right, I'd call and set up a payment arrangement for settlement.
Answer the summons regardless.

You need to appear in court on the given date and ask for DV during discovery. You just might have a chance to turn the tables.
Show up to court
Go to court and request proof. Chances are the attorney won't be prepared. At least that's what happened with my husband's case and it was continued until September.
