I was just visited by a State of Texas Supreme Court Registered Process Server to deliver a "Justice Court-Civil Citation". This is from MSW Capital, LLC C/O Michael J. Adams, PC. This is the firm representing Chase/WAMU. It states that " if I or my attorney do not file a written answer with the clerk who issued the citation by 10 am on Monday the next following the expiration of 10 days after you were werved this citation and petition, a DEFAULT JUDGEMENT may be taken against you." It goes on to state, "that you're hereby commanded to appear before:.....Justice of The Peace.
My question is this: 1) Do I need to find an attorney? 2)Do I really need to appear? 3) What does the issuance of a judgment really mean?
Any advice would be appreciated.


1. Its up to you to find an attorney or not. You can just as well do without one but if you feel a little more confident appearing in court with an attorney, you should get one.

2. Its up to you again but in my opinion, you should appear in court. Use any valid defense you may have. If you don't appear in court, nobody has anything much to say and a default judgment is awarded to the plaintiff (MSW Cap/Chase)

3. A judgment or a default judgment against you would mean that MSW Cap/Chase can garnish your wages and put a lien on your assets. A judgment would also appear on your credit report and you might have a hard time finding easy credit after that.
