My father was at home an a gentleman approached him with papers. He slid the papers through the door and left. Now it was a court date for my mother where cach llc is suing my mother for the amount of 3500 for an account that she had about 2 years ago with chase. A credit card account. We live in Florida. Now my mom has been unemployed and currently has no bank accts Etc. We are in a difficult situation trying to make our mortgage payments and really Cannot pay the money she owed my mom has never admitted that she owes the debt or has never Spoken To anyone from the collectors or attorneys My father use to work full time however they have cut his hours.last year he made approximately 17,000 what is the next step she should do? My mom is 56 years old. English is not her first language and she's very nervous since she's never been in trouble. What is the next step to beat the cach debt agency. On the papers it mentions my mom received paperwork that she was informed of sale of chase debt to cach. Which is false. They attached a copy of the chase cc statement. Please help thank you is there anything she can bring to court so that the judge can dismiss the case or find a technicality. Please anyone assit me. Thank you


The point of the matter is that your mom has been served and she needs to appear in court on the given date or a default judgement will be awarded to the plaintiff (Cach LLC) and they would be able to garnish her wages (she is unemployed so there is no chance of that happening) and place a lien on her assets.

1. It doesn't matter if she has not admitted to the debt as long as Cach can prove it is her debt.

2. Collectors can actually sue without a notice.

3. The best you can do right now is to ask for debt validation during a motion of discovery in court.

Things look a little grim but don't lose hope and no matter what, appear in court on the given date.
