Progressive Debt Collections?

I called my parents last week when I received a text from my dad that said "You need to call me. Or are you in jail?" When I got them on the phone they said someone had called telling them they are looking for me for check fraud. They gave me a telephone number and I called back. It was Progressive. No other information, just Progressive. When I got someone on the phone they went on about an internet Payday Loan I had received in March of 2012. The company tried to collect the debt two days before it was supposed to be due, sending my account balance in the red. Way in the red. I was unable to catch up and pay it back. Now these Progressive people are calling me. I have been threatened with criminal charges, civil charges, and they call and call and call and call. I spoke to a Ron this morning requesting all of this information in writing and was told that he was not obligated to fulfill my request and that a letter had been sent to me over 30 days ago and it's "not his fault I don't open my mail." I have filed a complaint with the FTA and need to know where I go from here. Please help. Thank you.


A couple of things first:
1. Which state are you from?
2. What is the name of the lender?

You need to know that collectors cannot have criminal charges filed against you since the failure to repay a debt is a civil offense. You cannot be jailed.

I believe this a bottomfeeding CA so as soon as I can confirm that the loan is illegal or somehow not valid, the sooner you can get yourself a NACA attorney and sue their pants off.

even if the loan was legal what this piece of trash did is not.owing any pdl is a civil matter not a criminal one,and stating fraud they are saying it's a criminal matter.this place needs to be reported to the police as well as your AG,and the FTC.again threatening arrest is and of itself an illegal act that needs to be reported and ignored.btw.i'm certain there is no real info on them making a lawsuit pointless besides the OP needs proof like the threats on tape.however they must look into their state laws in regards to recording calls.some require both parties know the call is being recorded.in this case i recommend reporting and ignoring.the father needs to file a police report as well because the call to him broke the law as well.
