EZ Pay Day Cash, which is located in Utah, is licensed by the State of Utah to make small loans. All such loans are approved and funded in Utah, with repayment to be made in Utah. The EZ Pay Day Cash loan agreement and website contain all disclosures required by Utah and federal law and make it clear that all transactions are governed by Utah law. On the advice of counsel, EZ Pay Day Cash maintains that the choice of Utah law as controlling in the loan documents would be upheld, as all of the significant contacts in the loan transaction occur in Utah. The loan agreement is legal and enforceable. In responding to your correspondence, EZ Pay Day Cash notes and reserves all available legal and equitable objections to the points you have raised.

EZ Pay Day Cash provided this service as a convenience to you. We still consider your loan to be outstanding and are prepared to go to arbitration as provided for in the Loan Agreement between us. As an alternative, if you are experiencing financial hardship, we will be happy to speak to you about payment arrangements through which you can successfully meet your payment obligations. EZ Pay Day Cash will consider doing so because of our continuing commitment to servicing our customers and not because of a legal obligation to do so.

Should you have any further questions regarding this matter, if you wish to speak about payment arrangements, please contact us at (800) 474-5586.

Sincerely,

Customer Service

It does mean crap.

Dear Ezaydaycash

Save your garbage for some other uneducated consumer. I live in the state of NJ and as you well know, those are the only laws that are applicable to me. You know as well as I do that payday loans are PROHIBITED in my state and many others. You are at fault to lending it to me. Refund my $200 immediately. Complaints are being submitted to both the NJ State Attorney Generals Office and the FTC.

Thanks Soaplady. I actually live in Indiana, where payday loans are legal, but they have still broken the payday laws of my state.

respond as soaplady advised, but add this as they put the arbitration threat in there.

go ahead arbitrate.it has to be done in IN not UT so i actually want that as after the arbitrator finds for me you will be forced to give the 200.00 overpayment.

i know they throw that in there just because, but let them know you are aware of that.
