I opened up a credit card in 2002 and was unable to pay the debt. In 2008 the card was written off and sold to a collection agency. The collection agency called me and told me that they were going to be suing me for the debt. Can they? its been 10 years


first who is the collector?second the SOL starts after first delinquency.not when the account is opened.if the clock started in 2008 then it has been 4yrs.quite a difference now a couple of questions.

1)again who is the collector
2)when was the first deliquency
3)what state are you in

the original creditor was hsbc bank(credit card) ..written off in 2008...J & E financial is now the debt collector...My first delinquency was in 2004. first someone called me yesterday and said that they were about to serve me for this unpaid debt( the number was out of state) I got the case number and called j & e and they told me that the account is only 4 years old from 2008 and i still owed it..I dont understand these laws regarding credit card debt..I have been sued in the past and I dont want my pay attached

never heard of this J&E,but they sound like a bottomfeeder.one more question.was the last time you paid on this 2004?if so then this is a bottomfeeder because the SOL in CT is 6yrs meaning this is past SOL and they are lying and threatening because if they were to try and sue you use the SOL and it gets dismissed.they need to use pressure and scare tactics.was the absolute last time you paid 2004?that is important.
