I received a summons to appear in court on credit card debt and called the creditor...

it is a law office who wants me to pay them for a credit card debt with FIA Card Services. I am in IL and the card was opened in 2006. I entered into a payment plan with them in 2007 (spent too much too fast, I couldn't catch up, they closed the account) and made payments until May of 2011. I received a summons this month (July 2012) and called the law office that sent it to me. The lady was very nice and tried to help as best she could, so out of the call, she informed me that she would request a validation from FIA Card Services and should FIA not return the validation prior to the court date, the law office will not pursue a judegement on that date, but will more than likely request another court date. After receiving the summons, I totalled up the total amount I paid over the years Basically it seems, I spent a little less than $5000 and paid over $6000. Now they say I owe $2800 + court costs. I disagree and do not beleive I owe this debt. What can I do?:???:

They will not request another court date...they will go ahead with the one they already have. Once you receive a summons, it is too late to DV...proof of the debt would have to be done in the discovery phase of the trial. And let's face it...FIA is BOA...they can prove you owe the debt.

You are forgetting interest which on most credit cards runs from 15-30%. It adds up fast.

Don't worry too much. If you don't believe that you owe them that amount, ask them to validate such debt and then wait for whatever is their response or if they will still respond. Im pretty sure that it will take several months or even years before you receive another response. Also, what if they pronounce a judgment? They cannot force you to pay if you really cannot afford to pay. The best thing that you can do now is to wait and while waiting, why not get a free credit consultation from xxxxx Consultants.
