I'll keep everyone posted!!

Good job! I fought Cash Call several years ago, and Plain Green more recently. Both were paid back MUCH more than I borrowed, but I still get letters or emails from Cash Call (Delbert Financial) once in awhile.
I was SO scared when I first stopped paying them, but now I look back and laugh at myself. :)

Unless you're in Delaware where lenders can screw you for every cent you've got, you can get it off your credit report and contact cashcall to work out a settlement. custserve@cashcall.com is how I recommend further correspondence with them. Call the credit reporting agencies on the phone and have them file a dispute; the representatives I spoke with when I went through this with cashcall were familiar with it and took it off. They (cashcall) did not report to TransUnion but DID report to Equifax and Experian.

First call Nevada's banking regulator to make sure they are not licensed (the site is here http://www.fid.state.nv.us/)
If they confirm CashCall is unlicensed, then you should be requesting a refund check, not offering a settlement. I mentioned the settlement if you still owed money on the principal. If the loan was originated through Western Sky, CashCall's license is irrelevant. Regardless, it will still be an extra thing to put in the email when you contact them asking for your refund check (e.g. "Western Sky is an illegal tribal lender and therefore no loan agreement with them is enforceable... CashCall, your company, is also not licensed to lend in this state...) << just a sample.

Sorry, it won't let me edit my above post.. but please do not deposit the refund check into your new bank account (I hope you have made a new bank account!) as these guys will have access to your new numbers. Take it to Wal-Mart and swallow the 3 dollar fee to have them cash it.

I meant why should I offer them a settlement? I'm not going to as I already paid beyond the principle. Cash Call is not licensed in Nevada. You can't even go past the front page if you click you live in Nevada.
As far as a refund, that's not my main concern, I just want it pif.

Good luck BellaLisa. I disputed the Cashcall entry on my credit report in March and it was found to be valid. I have also filed complaints with my AG and the FTC. Also, when I go to their website it says that my state (Colorado) is not serviced by Cashcall. I sent another email to them today asking for my $1,000 loan for which I have paid $2,052 to be considered paid in full. I'm guessing that they'll just do what they do every other time I complain about the validity of the loan which is to send me a copy of the agreement and say that the Cheyenne Sioux Nation is sovereign yadda, yadda. Anyway, keep us posted. Hopefully they'll be put out of business soon.
Just to clarify I think you misunderstood me. I didn't mean you
Just to clarify I think you misunderstood me. I didn't mean you should pay them more i.e. settle. But you are owed over 800 dollars. I would tell them you want your 800 dollars back.
Makes no sense...
I don't understand how the credit companies can find the loan to be valid if its an illegal loan. It doesn't make sense!

To be honest with you, the amount of effort those credit companies put into checking on these things is hardly anything.

^ Yup - once you start threatening them stating they are in violation of federal law they will clam up and delete them. If you are in California, remember they ARE A legal lender there.

I don't understand how an illegal debt is considered valid either. The only thing that I can think of is that since it doesn't show as a negative account that they didn't put much effort into researching the validity of it. I disputed it again and filed a complaint with the FTC about the credit bureaus allowing it to be reported so we'll see what happens this time. I plan to keep fighting too to get it removed. Cashcall is the only payday type loan that I still have so I'll be really glad to get this resolved.
california
Well if you got your loan through cash call, in California, they do have a license to lend. California is one of the only states they are licensed to lend in. It's going to be harder to get them to budge.
If you got the loan directly from CashCall, it's legal in CA.
If you got the loan directly from CashCall, it's legal in CA.
If you got the loan via WesternSky and it was then transferred to CashCall, it's not legal.
How can I make sure the my loan is from Cash Call
Is there someway to trace my loan to see if Western Sky is involved with my loan? I have paid all the principal back and over 2000 in interest.

So quiet...
So I still haven't gotten a phone call from cash call regarding my loan. They usually call me after the first if I haven't made a payment. Maybe they are waiting until the 15th when its technically late, or maybe they are taking into consideration that I also put in a cease and desist in my letter.
I faxed complaints to the Nevada Financial Institutions Division, and now I'm going to be fighting with the CRAs....
Miss Fortune
I tried to get a western sky loan in California and they told me that they didn't lend in ca because they were the same company as cash call. That was before I knew all this information that I found on this site. Just saying '
