NH payday loans
Date: Wed, 07/25/2012 - 12:30
I have 5 payday loans currently, and I live in NH.
Ameriloan - orig 300 - pd 250 interest only
United Cash loans - orig 300 - pd 360 interest only
Sure Advance Loan - orig 400 - pd 212 interest only
Advance Me Today - orig 400 - pd 130 interest only
Gentle Breeze - orig 400 - pd 260 interest only
I bank with Citizens Bank, and I went down there today and put an "all funds hold" on the account (I used the reasoning of recently finding a fraud transaction on there from Moneyonthego.net for $99.95 which I never authorized) and opened a new, completely seperate account.
My questions are, 1: according to the "state payday laws" thread, If a lender isn't registered in New Hampshire, do I not have to pay back any of the money lent? Or do I still have to pay the principle?
Question #2: What is my next step? Simply writing to these payday loan companies and telling them I'm not paying them any more interest?
I look forward to good conversation, this board has been a lifesaver. Thanks to all who can help me out.

All of your lenders are illegal.
Technically, there is no regulation that requires you to repay anything to these lenders.
Our stance, at DCC is that, as a moral issue, you should repay the principal.

As it turns out, I re-worked the maths, and I overpaid UnitedCashLoans by $60, and I overpaid Ameriloan by $40, so they won't be getting anything from me and I'll keep on them for a refund, although I don't expect to ever receive one.
As far as the other three lenders, thank you for confirming that they are not legally licensed to do business in NH.
Come hell or high water, I will repay all 3 by original amount borrowed. I took the loan, it is my responsibility to pay it back, there was just no way I could do it paying 400% interest every 2 weeks.

I have received the following from Sure Advance:
"Dear Anonymous,
Thank you for contacting us.
Please be aware that this is a St. Vincent company, St Vincent and the United States are both parties to the General Agreement on Trade in Services, a treaty which specifically permits companies in one country to make consumer loans to citizens of the other.
Under the treaty, we are only obligated to follow the federal laws of the United States. We are not required to obtain state licenses and individual state laws do not apply since the federal laws adopting this treaty supersede any state's laws on the subject.
If there is anything else we may do for you do not hesitate to contact us again."
Any advice guys and gals?
Should I just respond with "Your treaty means nothing to me, I'm obligated to follow NH State law, not St Vincent law, so again, please let me know how I can make arrangements to pay the remainder of the original amount borrowed"
From what I've been reading, most of these illegal lenders are really thick-skulled.

247GreenStreet.com
Thank you all very much for your responses, and thanks to OHGal for editing that post for me. I really do appreciate all the help.
I do have one more question as it relates to 247GreenStreet.com
Accoriding to the forums, 247GreenStreet.com is not a legal lender. I have checked the New Hampshire banking website, and they are not listed as being licensed to do loans in my state in any way.
So here's the deal: 247GreenStreet.com does not do rollovers. If you take out a payday loan from them, they do an ACH from your checking account on the very next payday for the ENTIRE amount due, plus interest. Because I had so many pdl's, I would often times pay off 247greenstreet, and then the following monday have to get another loan with them to help pay down some other pdl's.
Here is the breakdown of what I've paid 247GS:
5/09 borrowed 300$, paid 359.94 on 5/18
5/23 borrowed 300$, paid 359.94 on 6/01
6/06 borrowed 500$, paid 599.90 on 6/15
6/27 borrowed 300$, paid 359.94 on 7/13
At that point, I had borrowed $1,400 and paid them total $1,679.92.
I then borrowed 300$ on 7/16, and then came to this website and started the process of cleaning up my mess, I put a hard block on my bank account this week. 247GreenStreet was scheduled to deduct 359.94 from my account today, but as with all the other pdl's, it was probably blocked, because not a single penny came out of my bank today (go Citizen's Bank!)
My question is, since they are illegal and I've overpaid from the past loans $279.92, should I email them and tell them I only owe them $21.08 on this most recent loan? Or since they don't do rollovers, should I make arrangements to pay them the entire 300$ I borrowed?
Thanks again everyone for your input.
