I live in tx. Had a payday loan with pepper cash. One payment bounced back NSF, they never called or tried to rerun it. Now I'm getting calls from unified portfolio services out of NY saying if I don't pay now they will file in my county against me.
I asked for documentation and they said they'd provide it when the lawsuit was filed.
Do I have options?

No you dont. You send a cease and desist informing them they are collecting on an illegal loan and that the contract signed is invalid. You tell the CA to bug off and never contact you again.

There's an agreement out there somewhere with your esignature on it. Protect yourself and revoke the wage assignment.

The DA in TX will not accept PDL defaults as hot checks. They're considered a line of credit.

This is a licensed lender you're dealing with, however, so, you do need to work out a payment arrangement with them and get the account paid off.

Well, that won't happen. They're trying to scare you into paying it. Just keep at them for a payment plan, or better yet, tell them "this is what I can pay and how often" and then start paying them back. Keep records and receipts of all payments.

Try also calling the TX Office of Consumer Credit Commission at 800-538-1579. Let them know what these people are threatening you with. They may threaten their licensing if they continue these practices.
