I recvd a disturbing, threatening call from a lawyer last night regarding a payday loan I took out a few years ago. He said the lender was American Cash Advance. I also took out a loan from US Fast Cash, but that is not what this one is about. I remember it was about $400. I know I paid that back, plus interest. I do know it kept on adding up. As a single mom I did not know what to do. I consolidated the 2 loans but it seemed to never get paid. My son got sick & I couldn't make any more payments.
So now it seems there is a whole list of charges, & a warrant out for my arrest if I do not pay $689.25. I would be willing to make small payments. The lawyer does not want to deal with that. He was very loud and rude. Please help.

i couldn't put it any better than how soaplady did.report and ignore.a complete scumbag bottomfeeder not a lawyer.

Thank-you BOTH for such quick responses. I do feel a bit better.
I'm still scared & jump when I hear sirens outside. The charges seem so serious esp "check fraud".I am considering contacting the original lender and see how much interest I still owe. BUT, if you say it is payday loans in MA is illegal, maybe I will let it go. I'm also considering finding an Attorney to look into this. I just don't want to have to all the time. I am reluctant to report this just in case this lawyer is legitimate & does send a warrant out. I googled the law firm & it does exist.
**It is so sad that people (as I was) are so desperate they reach out to these payday loan companies***

You CANNOT be charged with check fraud. Period. There are no charges....they are breaking the law.

You owe principal only...nothing more.

Dont waste your money. The attorney might be legitimate but the debt is not. Report it. There are a lot of abusive collection attorneys out there that need to be reported. Plus you more than likely did NOT speak with an attorney but a collector.

Here are MA laws...call the regulator if you have other questions.

Massachusetts Payday Loan Laws

State Legal Status

I actually did make many on-time bi-monthly payments. What started out as a $400 loan ended up costing $800 (which I paid). So I paid the principal & a whole lot more. I just couldn't continue. With 3 young children, I couldn't pay them one more penny. I borrowed the money so I paid it back. I'm not sure what I did to cause this sick harrassment. But, I did file a complain with the FTC.

if what you just posted is true then the lender owes you a 400.00 refund as again you only owe the principle, and interest is not allowed.meaning anything debited over the principle should be refunded back to you.file any and all complaints against both the lender, and this attorney(AG,FTC,and the bar assoc)just try to ignore the loser as you are owed by this illegal.not the other way around.
