Is there anything I can do to get rid of this payday loan? They say they are not a payday loan, but it still seems like a crime what they are charging for interest. Has anyone had any success with getting out of a loan?


Technically you are already "out of" the loan if you don't live in California, the only state AFAIK that CashCall can do business in. If it was originated by Western Sky, under the law you technically owe them 0 dollars and 0 cents, even if it was a 10,000 dollar loan. Of course, even sleazebag pieces of dirt like them should be paid back at least the principal. I've given people advice with them and my father is actually paying them back 50 dollars a month on a 2500 dollar loan, just the principal. Here's the email he wrote them - "I know your loan is unenforceable and illegal. You can either take my 50 dollars a month to repay the principal balance or you can take nothing. This will be my last offer to you. If you don't accept the 50 dollars and send me back some crap about the Sioux reservations, then you get nothing. Thanks."

You need to send an email to the complaints department [EMAIL="complaints@cashcall.com"]complaints@cashcall.com[/EMAIL] . Tell that that you know that the loan is not legal or enforceable in your state and that you have filed complaints with the FTC and with your state attorney general. If have not already filed complaints with the FTC and your state AG then do so. In your email, site how much the loan was for (I'm guessing that you were actually loaned $2,000 on a "$2,500 loan) and how much you have paid. If possible, find the interest rates that are supposed to be charged in your state and site those. The bad thing about Cash Call is that since they do somehow report to Experian and Equifax you run the risk of destroying your credit until you can get the credit bureaus to remove it, and I haven't found anyone who has sucessfully done that.
