My mom passed away and owed money on a home she Quit Claimed to me. Home was never foreclosed on but here it is 3 years later and Dyck O???Neal is trying to get me to settle and they will remove the lien. We had agreed to 10K now they are changing their minds and my question is do they even have foreclosure powers? The debt was in my late mother's name not mine. Seems like if they could foreclose they would have 2 or 3 years ago.


I believe the Quit Claim Deed is what would compel them. Was there a lien placed on the property prior to the transfer? If so then I believe that Lien would survive a Quit Claim transfer, and as such the lien holder would have the right to force the sale of the property regardless of who the grantee is. That is why they are pressuring you to settle.

This is my understanding of a quit claim deed, but I would certainly seek out professional help on this one.
