Cashcall gave a small claims summons to one of my employees (I was a manager) and 2 days later I was fired. Not for the serving, but it was given to an employee and laid on my desk. Open piece of paper. No envelope. Everyone could see it and I'm sure it was talked about. Two days later I was fired for "falling asleep" at my desk. I had laid my head down and fell asleep for a short period. I have not set break times and most of the time never have taken breaks as management. What can I do? I'm still in shock. I had worked here for 9 years in management. I'm a single Mom with a kid in college.
Thanks.

Court actions and summons are public information. No envelope is required.

There has to be more to the story...people are not fired for falling asleep at their desks. 90% off all office workers would be fired....

I live in CA and yes that is why I was fired. I just received my file today that I requested and I have no warnings of anything near to falling asleep. More to the story - It was late just before closing and I had already told my assistant store manager two days earlier that I had been having back pains (probably due to helping set up a staging area for one of my very successful Kids Day events) and my back was really hurting that night. I turned a chair around backward and lay across it to try to relieve the pain. I must have dozed for some minutes. I have a question - if my ASM saw me on camera, why didn't she rush to wake me? What if I had had some sort of attack? Cameras are always on. I would have rushed like Hell to see if my employee was hurt. Because she has not liked me since the day she arrived a little over a year ago. I am very good at my job and have the highest marks in all my reviews. I have all the copies. There is no reason at all to fire me without warning me that it better not happen twice. Now you have the story -what do you think?

Hi and thanks for setting me straight. Where should I go online to get answers for wrongful termination? I am going to speak with an attorney. I have an open workman's compensation from getting hurt as well. It's just not a very nice situation I had a new ASM come in that didn't like me from the start. I am very efficient and I think I scared her. I actually said I would have her job some day. Meaning I would be in a higher position not her job exactly. Thanks.
