My father is getting calls from someone called "Hyperion Recovery" looking for him to pay 693 dollars on a 100 dollar loan. First off, he's a NYS resident so it's obviously illegal. This is the info they gave us

Original Creditor : http://national-paydayloan.com/

I went to their website and cannot find a phone number. I sent them a contact but doubt they will answer. Does anyone know of their number? If so, should I just call up and ask if they have my father on file? My father got them to settle the debt for 153 dollars but I made sure he put it on a credit card so he can file a dispute if need be. It's looking like he may have to if this company has no record of my father. Just curious if anyone has a phone number for these guys. Keep in mind they appear to be a tribal lender as well.

I can't find a number either other than many which I believe is disconnected. I'm not sure what your dad can do about the money. File maybe an improper charge and say it should only be 100. Like "they charged me 153 for a 100 dollar " Wait for one of the experts first though before doing thT

Thanks for the advice guys. I called my father's CC company who did a 3 way call with them and Hyperion refused to refund the money. I got in contact with National Payday Loan who said that Hyperion does NOT own the debt and that it was actually sold to a different CA, who I called and said they were not planning to pursue it (probably for the low balance and being a NYS account). The CC company is going to suck the money back from Hyperion. Watch out for these guys in the future!

Did he get a $100 loan? Did he pay anything back prior to this call? I'm assuming he defaulted but am wondering if he paid any fees/interest/renewal payments prior to that.

This is an illegal, tribal lender as you mentioned. He should only repay the $100 principal and anything that has already been paid counts toward that $100.

Cancel the credit card payment.

He got charged 1 30 dollar renewal fee. At this point I'm just going to advise him to forget about it. The original creditor was very polite and basically said, look, we got our money back through insurance - it's with a 3rd party CA who bought it from us for practically nothing. The CC company is charging back the entire payment and that'll be the end of it. I'm going to draft a C and D to Hyperion as well. I'm curious - Ohiogal or Soaplady, do either of you know if I can get them on a FDCPA violation for this? They didn't report to the bureaus but I feel like this has to be illegal when they are collecting for debt they don't owe.
