:confused:I reside in New York. I had requested a loan with Western Sky in December of 2011 for $2600.00. The principle amount of $2525.00 was deposited into my account minus the $75.00 origination fee. Then Western Sky sold the loan to WS funding which they claim Cash Call is now servicing. In March the loan was paid off and when I totaled all of the payments WS/ CC had received $3301.75 . So in April of 2012 I decided what the heck I'm a little strapped for money why not take out another loan with Western Sky again I requested $2600.00 with the principle amount of $2525.00 deposited into my account minus the $75.00 origination fee. I had made two monthly payments totalling $469.96. Then I fell on hard times. So I called WS/CC to try to make payment arrangements and they wouldn't even considered it. The people on the other end of the phone was so disrespectful that I hung up the phone. The next day they called back I attempted to make payment arrangements again and they even tried to belittle me. The person stated that I should take out a loan from a friend or a family member to make the monthly payment. How ridiculous. So I found this site and decided to send them a letter a validation to which they e-mailed me a copy of a contact and mailed me a copy of the contact via USPS. Both have the same account numbers but with different figures and and different dates. I also sent them a C&D letter. CC is also on my CR and I disputed it. But to no avail. I have notified the BBB and the FTC. What other recourse do I have to get them off of my report? And can I deduct the overage from the previous loan?

Call in to the credit bureaus using your report number and speak to a human. Here in NY, a loan cannot have higher interest than 16%. If it is between 16 and 25, it's civil usury. If it is above 25, it's criminal usury and a class E felony in the second degree. Tell cash call you are aware of this. I'm currently fighting them for my father and they are being somewhat cooperative because they know we ain't planning to pay them back 15 grand for a 2,500 dollar loan.
