I repeat ...I am willing to pay the remaining principal balance of $62.50. I live in the state of NJ and NJ state law prohibits payday loans which means the loan I have with you is invalid, the contract null and void. You cannot enforce it in a court of law and if you damage my credit I will sue you. You can go ahead and place me into collections...I will simply send them a cease and desist letter. You can accept my $62.50 as payment in full or you can make this more difficult for yourself. I will not pay a dime more and you know darn well that you cannot enforce the debt. Your threat "[COLOR=Black]I guarantee you they (third party collection agency) will call every number possible and then some" doesn't scare me. If they violate the law, I will pursue them for FDCPA violations.

Last week I had 3 separate e-mail conversations with this company. The last one on Friday with Frances. I have paid $375 on a $300 loan - told all 3 including Frances that I would not be paying another dime as Archer Direct is not licensed in Missouri. The initial e-mail from Frances indicated that I owe $480 but they would be willing to settle for $330 (?). Of course, I refused to pay either amount. I was told that the account would be sent to a 3rd party as of the 31st so I'm expecting the worst. The e-mail also indicated that my wages could be garnished and/or I could be prosecuted for check fraud. I sent the wage revocation e-mail a couple of weeks ago which included my request for a PIF letter. I've also filed a complaint with the Missouri AG's office.

I've had numerous emails with several individuals at Archer Direct, I've sent certified letters as well. They still continued to call me at work, but finally stopped. My last communication was with Patrick in mid-August. It seems now that they're website is down. If there is ever a class action lawsuit against these people, I'M IN! They loaned here in Missouri too, and they are not licensed in Missouri so the only amount I owed was the principle amount of the loan, which I paid and then some. Talk about a headache. I'd rather the real bill collectors call me than these guys.

I had reported Archer Direct to the Missouri Division of Finance, filed a complaint with the FTC and another agency whose name escapes me at the moment. Good luck getting anywhere though. The Mo Division of Finance will take your information and send a letter to Archer Direct, which I guarantee will be ignored. I don't know if anything will ever be done to Archer Direct, but I hope so. They are harassing (and illegal)!

On August 28 I spoke with Brian at the MO Div of Finance. He was very nice, said they would send a letter but doubted it would do much good. He said there were several complaints in the office regarding Archer Direct. I haven't heard from them since my account was sent to collections on August 31 but I'm sure at some point I will. The real reason for answering this post is to let fellow Missourians know, if they don't already, that there was a grass roots effort in the state to get an initiative on the November ballot to reduce the interest rates and fees on payday loans from 445% to 36%. The petition drive was manned by countless volunteers along with Churches and other advocacy groups and 350,000 signatures were obtained. In August, Sec of State Robin Carnahan's office announced that there weren't enough "valid" signatures on the petitions for the initiative to go forward and with a mid-September deadline to validate the signatures the group didn't feel as if they had enough time. The payday loan industry spent 2 million to keep the measure off the ballot all of which was funneled through a not-for-profit that has not to date named its donors and probably never will. The supporters accounted for all of the $600,000 they spent, as noted in reports from the Missouri Ethics Commission.
