Any way to get them to stop ACH payments without closing bank account?
Date: Tue, 09/04/2012 - 11:19
I did take the step to send them an email to tell them that they are illegal in the state of Wisconsin and even went as far as telling them that my bank will reject any ACH payments they try to take this coming Friday. It's been 4 days since I sent the email and I haven't heard anything back.
Just wondering if anyone has any advice on how I can go about this without closing the bank account. I could understand doing it if I had a bunch of loans out, but I just want to get rid of this one.
Thanks!

Talk to the Branch Manager at your bank! If this is the only payday loan that you have, you may want to do a Stop Payment on the ACH you are expecting on Friday. The the bank may charge you a fee and the stop payment may only be valid for six (6) months. HOWEVER, there is nothing to stop the lender from sending through multiple transactions if the scheduled amount is rejected.
Show the Branch Manager the ACH Revocation Letter and let them help you decide what the best course of action would be.
My bank actually recommended closing the account, which I did, and they placed a hard block on the old account to ensure no ACH deductions occurred.
Good luck!

Did you give the PDL an ACH revocation?? It should go to them before you bank.
You really need to close your account and open a new one. It is the only way to secure your account

Thanks for the advice. I'm going to call my bank tomorrow regarding blocking the ACH payment this Friday.
I've also decided to harrass CashWebUSA (professionally, of course) to the point where they get sick of me calling and just close the account.

No, you cannot call. You must take in a copy of the ACH revocation you sent to the PDL. You need to sit down and talk with a branch manager.
I did not. I'll do that right after work. Do I just tell them
I did not. I'll do that right after work.
Do I just tell them that I'm revoking them from taking ACH payments?
I'm going to try to pull this off without closing the bank account first, just because I'm not in a desperate situation with multiple pay day loans open. Plus, I have a pretty good bank and I trust that they would cover for me if Cashwebusa tried anything shady.

Did you read what I wrote??"?? You need to give your bank a COPY of the ACH revocation that you sent to the PDL. Read the link in my signature line for information on how to follow illegal loans....you need to follow ALL of the steps.

Thanks. I called CashWebUSA last night and harrassed them a little bit. I also sent my bank a fax with the ACH revocation that I sent the CashWebUSA.
It looks like I have my bank on my side on this one. I realize that there's a chance that they'll try to collect all $300 of the loan on Friday. My bank already said that they will return any ACH payments from this company.
I'll keep you updated.

Why on earth would you call them and harass them??? That will only result in them harassing you at work, harassing your family, friends and neighbours and them probably attempting ACH revocations under other names. That was a really stupid thing to do.
I may have been a little strong in saying I harrassed them. I ju
I may have been a little strong in saying I harrassed them. I just called them because they hadn't replied to my email yet. I talked with a "Supervisor" to remind them of the payday loan laws in the state of Wisconsin.

Basically, what I'm trying to do is to persuade them to mark my account "paid in full". I've seen stories posted here where people have been successful in doing so, though I understand the risk of doing so. Luckily, my bank is really great and they've already told me they'll work with me if anything shady happens.
Plus, I'm not in a desperate situation with many payday loans open, so I feel like I can afford to take this route first.

So I received this response from them yesterday. I basically responded by saying that it doesn't matter that the contract I signed follows Costa Rica laws and then I followed that up with the template in the the "how to deal with unlicensed lenders" email asking for a refund.
I haven't heard a reply yet. Would you recommend that I follow up again with a phone call to confirm that they received my response?
I did log in online at their website, and my loan status is now "Returned Item" even though they didn't get a rejected payment yet. I'm definitely curious to see if they're going to try to take out $300 tomorrow. I've followed the necessary ACH block with my bank and they've confirmed that they'll reject it.
This was what they sent me:
I have been notified by my staff regarding your concerns about your account balance remaining. You cited the laws governing payday loans in your state of residence; however, if you refer to the contract you signed with CashWebUSA, you will notice you willingly chose to subject yourself to the laws of Costa Rica. Despite this fact and in order to maintain customer satisfaction - our most important goal here at CashWebUSA.com - we will suspend all further fees related to the processing of your loan and you may remit to us the principal balance of $300.00. You may mail this payment to:

since i am not a resident of costa rica my state laws apply.also since i paid 450.00 the settlement is an insult.i am informing everyone i know, and at my job that you are nothing but loons that should be ignored.i am filing AG,AND FTC complaints against you and am not talking to you further.lastly unless you extradite me to costa rica i'm not giving you loons another cent.

Yeah, I'm thinking they're ignoring me at this point. I gave them a noon deadline of today to mark my account "Paid In Full" and then sent one other follow up demanding a response. Each email was professional but I did threaten to file a complaint with the FTC if they fail to comply.
We'll see if they try to withdraw the full amount tomorrow. My bank actually recommended that I let it go through if they do and that they'll then send it back. The branch manager who I've actually known for a while mentioned that they've done this in the past and that when they do it that way it seems to send the message to these crooks to not attempt anymore ACH withdrawels.
With my communication to them, I give it about a 50/50 chance that they'll try to withdraw tomorrow. I get the feeling that they might just want me to go away at this point. ;)
