Payday loans in Texas

I took out a payday loan in 2010 with EZMoney Pay Day Loan in Houston Texas. I received a call today from a law office in New York stating that they will be serving me tomorrow by 3pm and they are filing suit against me for the loan. When I called the law office back they stated that they would be charging me with "Attempt to defraud" and "Bad check claim". They stated that when I took out the loan that I gave them a bad check, which is why I needed the loan because I didn't have any money! They gave me a case number and when I went on the county website to look up the lawsuit, it wasn't there. I inquired about the case # and they stated that it was a number generated in their office? The question that I have is are payday loan companies legal in Texas? If they are where can I find information on what they can and cannot sue for?
