HELP! Payday loans in NC

Hi,I had taken out a few payday loans on the internet a few months ago. They were $300.00 and one was $500.00 I kept having them renewed at the cost of $90.00 like every other week. The fees were getting be behind and caused my account to be overdrawn by over $1000.00. In fees alone I would say I paid them at least 3 times ($90.00 x 3) which is $270.00. Now - I have recently been contacted my a collection agency. Very threatening and saying call them back in an hour or they will have locator services find me and I can be criminally prosecuted for bank fraud/check fraud. Ok, scared, I made payment arragements. One company said I owed $600.00 because of additional fees. The principle was only $300.00. They drafted $300.00 from my account like 2 weeks ago (prepaid card) I wasnt stupid to give them anything else but a prepaid card. But I still owe them $300.00 which I am not able to pay. For starters, I already paid fees (refinance fees) from my bank account from the payday loan people....then it gets turned over to collections and I have to pay more? As far as I am concerned., I have paid them out. The other company said I owed over $1000.00 ($300.00 each for 3 pay day loans plus fees) but they would settle for $1000.00. They have me setup with weekly payments of 83.33. I have already paid them 217.00. Both coleection companies are very threatening. Can they have someone come to my house and take me to court? Because when I call to get changes made to my payment arrangment - they place me on hold saying let me check with the lawyer or let me check with the paralegal. Are they pulling my leg? I am supposed to pay today the $300.00 balance from the 600.00 one (which I only owed $300.00) and 83.33 payment - two different collection agencies. I do not want to pay a dime now after doing a little research. I am just scared I can be taken to court or jail for check/bank fraud. I was repaying these loans back. The transactions were clearly coming out of my account. AND, the fact that I have started repaying them back through collection agencies proves I have good intentions and not being deceitful. What should I tell them when they call me today because I am just waiting for that phone to ring? Again - I am in NC. I am not sure where they are located at. I would think not NC. Please help ASAP!!!!


Welcome and calm down! Payday loans are illegal in North Carolina. You are only morally obligated to pay the original principal amount borrowed, no interest or fees. At the sign in page, go to the forums section, payday loans, and click on the link detailing how to deal with the illegal lenders. Follow every step. Their type of harrassment is typical. They are trying to scare and scam you. Debts are civil not criminal. Keep us posted. We are all here to help you.

Payday loans are ILLEGAL in NC which means you owe principal only...no fees, no interest. Read the link in my signature line for information on how to dealwith them.

As for the CA's, they are breaking the law. Debts are civil, not criminal.

I hereby demand that you cease and desist any and all contact with me and anyone associate with me in regards to account #_________, original creditor _______________. Payday loans are prohibited in the state of North Carolina which means the account you are attempting to collect on is invalid, the contract null and void. Also, you have violated the FDCPA which may require me to consult an attorney to sue you.

Govern yourself accordingly.

So if they are illegal here - why repay them? I found out that the cap on interest rates on loans here in NC is 36%. The payday loan companies charged me 782.14%. That in itself violated NC State law. Im to the point where I dont think they can civially do anything simply because of they are in violation. They wanna battle and take me to court.....well Im gonna tell them - lets go!

Even though they are illegal we ask that you payback the amount that was deposited into your account. Morally it's the right thing to do no interest just the principal only. Please subtract any fees charged to date from the amount they deposited and request a PIF letter. If you overpaid you can also request a refund but don't count on it.
