As I battle my 7 payday loans- with one win against Ameriloan, others pending or silent, I do have another battle. Cash call. I originated a loan through Western Sky, and it is being serviced by cash call. From what I understand through reading various threads on this forum, western sky is not licensed in Colorado, so I only owe back principal, just like a regular pdl?
Also, cash call, who is calling me to collect the debt, MUST abide by the fair debt collection act?
I am planning on complaining to the Colorado AG this weekend, but my concern is the contract. Not sure why I am concerned about this one, when I am not about the other 7. I just am.
I took out $850 loan, they took $350 off the top as an origination fee. I have made two payments totalling about $230. In my mind I still owe them roughly $270 in principal and that is it. Am I ruining right? When I attempted to explain my position to cash call, they balked and states the loan was a valid, binding contract...blah, blah, blah and that collection efforts would continue. Bat what pint do they cross the line breaking the fair debt collection act?

I too have the same loan with cash call. I followed the instructions given in this forum and had them call me one time. They did respond to my email with the standard letter about the binding contract etc. I then sent them a cease and desist letter. I have not heard from them since nor have they attempted to take any more $$ from my bank account this month. I too am nervous but really do feel like I shouldn't be!

Hi Cindy, 3 days after I sent my letter I got a PIF statement, well that the account now had a zero balance and no collection activity will continue. I did not get a refund, and I didn't ask for one...I feel the interest I paid over the principal was my penalty for getting into the loan. I have skin in the game, so I am not looking to get anything back, just even. I feel its fair.
