CashNetUSA - Legal CSO. You pay what they say you owe.

Plain Green - Illegal tribal lender. You owe $940, not a single penny more.

Cash Jar - Illegal offshore lender. You overpaid by $950 and something on the same lines in case of the previous loan as well (I believe?).

Classic Loans - Illegal lender again. Stop paying! Right now! Revoke ACH authorization.

Ideal Gelt - Illegal lender. Overpaid by $800. Stop paying and revoke ACH authorization.

Speedy Cash - Legal lender, possibly a CSO. You owe them what they say you owe them.

500FastCash - Illegal tribal lender. Illegal lender. Morally speaking, you owe them the principal. Legally speaking, you owe them nothing.

Advance Me Today - Illegal lender. Illegal lender. Read above.

PaydayMax - Illegal offshore lender. Stop paying and revoke ACH. Ask them to either refund you from the previous loan or apply the overage to the current loan.

I am getting pretty tired of typing. The rest of the stuff you listed under online loan...well, they are all illegal lenders as well. Going around revoking ACH authorization for each of these lenders is going to be a pain. Just close down the bank account, open a new one and give your new banking details to the legal lenders.

I should have asked this before but could you please tell me which state you reside in? That would be very helpful.

Read this though and follow every step:

Thank you all for your comments. I'll follow your advice about the illegal lenders. Actually, I'll pay no payments even to legit payday lenders right now, since I simply don't have the money. 2 weeks ago, when the automatic debits hit my checking account it took it overdrawn. Then I got fees galore... then my direct deposit paycheck was issued to that account...

and it was eaten alive.

That's a real setback for me. So even the storefront lenders who have postdated checks will not get very far at the moment, now that I lost my entire paycheck. I'm sure their postdated check will simply bounce. I'll just have to pay them some other way, and not very soon. I have a different account at a different bank, and I have changed my instructions for our company payroll... they are to deposit no more paychecks to my former checking account. From now on, my deposit will go straight to the other bank.

Thanks again for all your advice. I will work on my emails to the illegal lenders, and post back here if I get messages of success. :-)

Thx Waffles, would i do it to the 800 number or my own bank? I was thinking of writing a letter like this to my own bank. Do you or others have thoughts about this? Might this work or is it too much? Thanks!

To Branch Manager:

My bank account is in crisis. I don???t know if it is still possible to save it. If you can designate it to be ???deposit-only,??? I will be grateful.

I have, of course, stopped writing checks on the account, except for three post-dated checks I was forced to write for lenders. My attorney tells me I cannot put a stop on them or close my Missouri account. All other checks initiated by me have been presented already, and have cleared. There are no checks outstanding and no items I am authorizing. There are clearly items I???ve not authorized. These seem to present nonstop, without pause.

Please credit my account for the resulting fees, and also for the direct deposit paycheck that entered my account and then became your money. Better yet would be to mail the paycheck directly to me???allowing it back into a DDA account at your bank is like putting it into quicksand. Years ago when direct-deposit payroll was first offered, many employees preferred to stay with the familiar paper checks. Having worked in banking for years, I always figured these types to be slow/ paranoid/ ridiculous. Or???are they the smart ones? I am astonished at what has happened here???and I am not alone. I told my colleagues today???they are stunned. My last paycheck vanished. I spent that pay period working round-the-clock???and never saw a penny of my pay. I understand I share some blame... but whatever you do about the fees you generated and the account you may close, the least you could do is mail my paycheck.

Especially considering some of the items/claims you did pay and the cretins to whom you gave funds. Some of the transactions are legit, but some of the ACH debits that have raped my account were never authorized. You allow others to steal funds???and then charge me NSF fees as they do it. I don???t know how to protect myself.

A somewhat-similar breach happened once before with your bank, about 3-4 years ago. Two Maplewood girls learned my account number and suddenly started using it to pay their boyfriends??? bills, by phone. They paid for cable TV and telephone service and online access and gym dues and gosh, anything they wanted, and brazenly???and why not? Nobody cared, and they knew it. Your bank didn???t care and the companies getting the money didn???t care. AT&T, Cablevision, none of them cared. They knew their services had been paid for with stolen funds???I told them! And still they did not care, and the thieves??? households in the hoodz were allowed to happily enjoy the service without interruption.

The only one who did care was my boss, who strongly resented it each time I had to leave work to go sign an affidavit. This could easily have cost me a job. He thought my loyalty was misplaced, but your bank did refund the fees and gave me a new account number, and that???s the one I use today. So that is why I have a 12-year-relationship with you, but my bank account is just 3-4 years old.

Now there is this new situation, and I regret having ever explored the concept of online lending. I have learned that good companies have affiliates who are bad companies. I feel you too, are to blame, for the way brazen thieves are allowed to rob accountholders.

Who is stealing from my account now? Various entities seem to be doing it, and I see that at least one???a stranger, to me???on Sept. 10th made an unauthorized deposit. Is it a test... or a claim to setting up a future large withdrawal ???payback???? There are also the hyenas who call me at my workplace to demand my account number. They try to scare me into saying it by threatening arrest. They seem to know it is all that is needed for you to allow their theft.

Another type uses multiple names, and other companies are rogue offshore lenders who answer to no one. They seem to make up their own rules, making me powerless to control my own account. I have tried to find contact info for them. For a handful of the miscreants, I succeeded; and sent an email saying ???No.??? I revoked any authorization they may ever have had to ACH my account. I don???t know whether my request will be honored. What I ask of you: should an item be presented for payment, it is not appropriate for you to pay it, and it is not appropriate for you to charge me. Please???help me. With NSF fees adding up, whatever you can do to disable this account will be appreciated. I will handle the legitimate lenders differently, on my own. I will pay each one of them separately, and eventually, in full, either in person or by mail.

It will be simpler this way for all of us???for you, for me, and for all the folks I owe. What used to be my bank account is now the spawn of Satan. Who would want to go near it? The swindlers can have it to themselves. Legitimate creditors will be glad to know they get to circumvent it.

I???ve been with this bank for twelve years, without incident until 3-4 years ago when that first account was compromised. That was a difficult time for me and my boss was not happy, and I won???t waste time again trotting in for signatures when no one is ever prosecuted. As a second aspect of getting through that time, a different account number was opened for me. That would work fine for me again this time, if that is still the way you like to do it. On the other hand, I really no longer need or trust an account with your bank in particular. I do request you mail me the missing paycheck and that you return whatever fees you deem to have been excessive and unfair. If we then close this account without opening another, that would work fine for me.

What I won???t want to do is continue to see the NSF charges this is generating; the cost is staggering. It is more than I can keep up with... it is more than I earn, working hard, full-time Please let me know how we can end this??? how you want to handle it, what you can do, and whether there is anything you need me to do.

Thank You,

Even better than the phone call is a letter like the one you drafted. The letter looks great but do not mail it to your branch manager. He/she does not have the authority to refund a massive amount of overdraft fees along with reversing a ton of ACHs. You need to find your bank's corporate office and send the letter there addressed to the CEO/President. That will get the letter routed to an executive liaison.

Could you tell us what your bank is so I can try to get you the exact mailing info and the person to address it to??

There ya go, shoot that letter you just posted in the forums to that address. Use a regular old fashioned business letter format. Make sure the envelope is addressed to him so it goes to the executive response team.

Hi all -- I sent an email to Advance Me Today that read as follows:

Dear Advance Me Today,

It has come to my attention that payday lenders must be licensed by the state of Missouri in order to offer loans to its residents. Since your company has no license in my state, the loan contract I have with you is not valid.

The illegality and unenforceability of your loan means that over and above the principle amount, I owe nothing, and a quick check of the records indicates that I have overpaid your company for two previous loans as well; # 179611 and 94140. Please confirm in writing that my account has been paid in full for all three loans.

There are no phone calls allowed to my work phone or my work cell. It is against company policy. As the sole debtor listed on this loan, I prohibit you from calling me or anyone else regarding my status, or future payments on this loan, or any other matter. You are not authorized and are expressly forbidden from calling my friends, family, colleagues, personal references, and all others, whether previously authorized or not, and any violation of this request will be subject to reporting and the possibility of lawsuit.

I am also revoking authorization for ACH withdrawals and any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.

I am not to be contacted via work telephone, or home telephone, or cell phone. My employer does not permit calls at work regarding personal business. I am recording any and all transgressions, and keeping detailed call logs to turn in to my lawyer.

Written correspondence may be sent to me and no one else. I request that all future contact with me be made through the US Postal Service, or online through my email account. As per instruction from my lawyer, I will need everything in writing to ensure a precise record of all communication.

Due to the illegality and unenforceability of your loan, the most that I would be obligated to pay is principle. However, I have in fact overpaid your company. As mentioned, I would like a written confirmation that my account has been paid in full.

Thank you for your prompt attention to this matter.

(signed by me)

Now I have gotten a reply... any idea how to respond to this? Thank you for any advice!!!

Thank you for contacting us.

Please be aware that this is a St. Vincent company, St Vincent and the United States are both parties to the General Agreement on Trade in Services, a treaty which specifically permits companies in one country to make consumer loans to citizens of the other.

Under the treaty, we are only obligated to follow the federal laws of the United States. We are not required to obtain state licenses and individual state laws do not apply since the federal laws adopting this treaty supersede any state's laws on the subject.

My reply from MynextPaycheck:

"MynextPaycheck is a tribal lending entity wholly owned by the Guidiville Indian Rancheria; a sovereign nation located within the United States of America , and is operating within the Tribe's Reservation. As a sovereign nation, this agreement falls under Tribal Law and not your state's regulations as we have sovereign immunity. "

W-ow. Who knew that reservations are actually sovereign nations?

Waffles - get this: someone from Advance Me Today kept calling my boss today. Over and over again. The first time, he said no, I could not come to the phone because personal business was not to be conducted on company time and company phones. The caller became irate; knew he was 'harboring' me, and were very upset with boss. And he was fairly upset with them, too! As soon as he would hang up, the phone would ring again. "Advance Me Today" got so "in the ring" with him that they nearly forgot about me...

At one point in this craziness, I myself picked up the phone first. I had expected it to be a customer... (it really will affect our business if our line keeps getting clogged like this.) Anyway, I picked up the phone, identifying myself... and they gave our business's physical location and asked if I could verify it, and I did... (I think they were trying to sound 'scary' as if they would send thugs to damage the premises, or send police to arrest me, or who knows.) and then they asked to speak to my boss. It turned out to be Advance Me Today, again, and the caller got in another argument with my boss. This is getting out of hand!

AND: a different lender called my bosses HOME today. His wife notified me and let me listen to the recording. They don't even identify themselves, but it must be one of my lenders trying to sound as scary as possible. They said they were at our county courthouse today filing suits against me on a variety of matters. Isn't it amazing that they would call boss's wife to say this? They are trying to scare me in preparation for whatever tact they try tomorrow... hoping i will cave to whatever they demand of me.

first get with your boss today and tell him to just hang up without a word when the leeches call.all they want besides ill-gotten money is to harrass and argue.a hang up followed by several more without a word gets the message across.as for the call to your bosses wife.it's staggering the accesiblity of info these days, and his wife needs to file a police report as the call was illegal and needs to be reported.ignore the idiots at work as neither of you are obligated to talk to these losers.so don't hang up and keep hanging up.
