11 Payday Loans (NJ)
Date: Fri, 09/14/2012 - 09:35
I live in NJ and have 11 payday loans:
Mycashnow
Cashwebusa
Unitedcashloans
Fastandreliable
Discountadvances
Everestcashadvance
Integrityadvance
Oneclickcash
Netcash123
Holiday Group
Bottomdollarpayday
I have tried to manage these loans, but they literally take my entire bi-weekly paycheck, leaving nothing for the rent/car or anything else. I have drafted the (ACH) revocation letters for each of them, upon finding out that payday loans are PROHIBITED in my state. I have over paid a few by a few hundred to a few thousand dollars....:?
My question is, what do I tell my employer, as far as the possibility of wage garnishment? How do I inform them of this possibility?
Also, I am heading to my bank to take care of the bank account, but bc I have a check that is waiting to be cleared and a monthly debit for some medical expenses, I can't out-right close the account; what do I do in this manner? Do I ask for an ACH Hard Block debit on the specific lenders?
Any help is very much appreciated......

I would strongly suggest you withdraw your money after your pay check is deposited, and then close your account. If all these PDL's are scheduled to hit on 9/17, that is the only way you can be sure to stop them from getting at your money!

Update 9/15
So here's an update for everyone...I bank at TD Bank in NJ, and I went in this morning and explained what was happening; they immediately CLOSED my old account, opened a new one ( made sure the two weren't linked in any way), and filed fraud papers on those lenders!
They gave me a copy of everything, and said that on Monday (9/17) when the debits are supposed to hit, they WILL NOT, as the old account can not be forced back open, due to fraud.
I shared with them, that one loan, "Holiday Group, LLC", which I obtained 8/10/2011 for $300. I was sick to my stomach to find that I have paid them $2520 as of 9/4/2012. I have never received an email from them about a payoff, a new balance or anything. Of course in the ach revocation letter, I have demanded my funds back to the tune of $2220.

I didn't know that about Holiday Group; I am baffled that these ppl have continued to debit $90 every other week out of my bank account, and not notify me of a balance, a pay down or anything. This is Loan shark work at it's best! But I AM demanding my refund of $2220 back, so I will follow-up to let everyone know how it turns out.
I have also overpaid Discount Advances by $929. On an $1100 loan, I have already paid $2029.88.
Integrity Advance, I overpaid by $1596. On a $900 loan from them, I have already paid them $2496; I'm PISSED!
Everestcashadvance, I have overpaid them by $362, on a $400 loan.
So again, I will keep everyone updated to let you know ho wit turns out.
I just can't believe that these ppl have gotten away with practically robbing the innocent, for so long!

Please let us know the outcomes. I'm going through the same situation myself with several pdl's that I've well overpaid, Netcash 123 being the highest. I'll let you know if I hear from Netcash 123. I sent my e-mails to the illegal pdl's over the weekend. Only one response so far, and that was telling me that my account went to a different company, I asked for the "new" company's name and address, as well as the original company's address, of course, no response so far.
Cash WebUSA (Update)
OK, so here's the response that I received back from CashWebUSA, after sending allof my emails this morning:
_______________________________________________________
Dear Customer,
I have been notified by my staff regarding your concerns about your account balance remaining. You cited the laws governing payday loans in your state of residence; however, if you refer to the contract you signed with CashWebUSA, you will notice you willingly chose to subject yourself to the laws of Costa Rica. More specifically, the contract states:
Governing Law: You have acknowledged that the key elements of acceptance of this Application by us, approval by our underwriters, disbursement of loan proceeds and repayment of principal and fees all occurred or will occur in Costa Rica, and you and we agree that any controversies that may arise hereunder shall be covered exclusively by the laws of Costa Rica.
Despite this fact and in order to maintain customer satisfaction - our most important goal here at CashWebUSA.com - we will suspend all further fees related to the processing of your loan and you may remit to us the principal balance of $450.00. You may mail this payment to:
CashWebUSA
Apartado Postal 19
Plaza Colonial Escaz??
San Jos??, Costa Rica
After you make this final payment of $450.00, we will record your account as paid in full. Please reply to this email stating your acceptance of these terms; by emailing us an acceptance acknowledgment, both you and we agree that this matter is fully and satisfactorily resolved and no further action will be needed from either party after the $450.00 payment is made.
If you would like to discuss alternative payment options, please contact our Customer Service Department at 877-365-0361 or by email at CustomerService@CashWebUSA.com.
Thank you for your cooperation with us, have a great day, and I look forward to hearing from you soon.
Sincerely,
Fabian Alvarado

I politely responded that I am only governed by my states laws, within the US, point blank. And legally I am not required to pay back more than owed on that account. They released to me $450, and I have paid $270, so I told Fabian, that I am ONLY willing to pay the difference, which is $180.
Waiting on a response now.
Update
So I heard back from one lender: Cashwebusa....... and they basically told me that I was governed by their laws in Costa Rica; however, bc they are inclined in providing excellent customer service, they will STOP all fees and interest, and allow me to repay only the principle balance of $450.
Well I only received $450 from them, and have paid them $270 thusfar, so I responded back that I was ONLY governed by my state's laws in NJ, and that bc I had already paid them $270, morally, I will complete the balance of $180 to satisfy the loan.
They have yet to respond back! Smh.......
Mycash now and Discount Advances
So to update everyone who may be looking for an email address on Mycashnow.com and Discountadvances.com; they are "sister sites", owned by the same entity.
The email address that I was sending my ACH revocation letters to was just a general customner service email; however, the emails bounced back to me.
So I contacted them both and received their "FAX" numbers:
Mycashnow: 866-318-2274 ( include your referral code as the "attention to" in your fax)
DiscountAdvances: 866-729-3376

I am not a resident of Costa Rica nor have I any intent to visit Costa Rica. You know as well I do that the only laws that govern me are the laws of my state of ________ and the federal laws of the USA. I have paid $270 towards my principle balance of $450 leaving a balance of $180. Please email me your address so I can mail you US postal money orders to pay off the remaining balance.

One(1) Down.....PIF Letter Recv'd
I received a confirmation of my ACH Revocation, cease and desist order from Everest Cash Advance, and also a PIF letter.
However, they owe me an overpayment of $362.00, which I am going back and forth on emails with them about now! They are telling me that the terms were mutually fulfilled, so they nor I have any further obligation.
I may continue to fight on this, or I may just chalk it up to experience, bc that's one less lender to worry about!

Fast and Reliable Cash
Just giving an update, I just heard back from another lender: Fast and Reliable Cash.

We are in receipt of your most recent communication. We pride ourselves in ensuring that we take care of our customers, and service their needs with respect and in a timely manner. You came to us on 8/8/2012 for a loan and we helped you in your time of need. While we may disagree with your interpretation of the law ??? as we are not located in the State of New Jersey and our loans are not written in the state - we therefore do not have a New Jersey License. We did not solicit you in any way, nor was the loan written in the State of New Jersey. You were given the terms of the loan verbally and in writing you verbally agreed to the terms and conditions and E-Signed the loan documents accepting and executing the contract.
However, in order to resolve this matter, we are willing to settle this account for the remaining principal of $365. We funded you $500 on 8/9/2012 and you have made one payment of $135. To consider your loan paid in full we must receive the entire principal amount back. Per your request, we are willing to accept the 5 credit card payments of $73 on 10/1/2012, 10/15/2012, 10/29/2012, 11/12/2012, and 11/26/2012. Please call 866-446-1760 or reply to this email with your credit card information to set this up. We will need the name on the card, expiration date and address associated with the card to set up the payments.

I responded back saying that I WILL NOT call to provide a credit card for them to debit payments from. I will call in each month with a pre-paid card, and if that's not acceptable, they can send me a mailing address to where I can get a money order to them!!

Otherwise, I will not pay. I also told them that they OWE ME a refund, bc this is the 4th or 5th loan that I've had with them, and have always paid the loans off in their entirety.

I'm waiting to hear back now!

SoapLady- you are so right!
They just responded back to me, saying that a Sr. Manager wants to speak with me and they would appreciate if I could provide a telephone number where I can be reached tomorrow.
I said absolutely NOT, and if you would've read my entire letter, you would see that all telephone calls are prohibited. If the Sr. manager wants to speak with me, they can do so either via US Postal mail or email ONLY.
So I guess they don't want their money; there's nothing else to discuss!

OhioGal- I lost track, but I think this is my 5th one with them. And you're totally correct, I can just subtract the fees paid on all of those loans; when I do that, of course, I don't owe them anything further.
I hadn't thought of that one!
Thank You

Notice my two edits above....this company who is violating TOS and is soliciting people after their bankrutpcies are discharged. I went to his website..he is a broker not a lender. The website is new, 2012 and has visable errors on it and looks copied from other sites. You are refered to loan companies without outrageous interest rates.....for people getting out of bankrutpcy, this is NOT the way to go.

I was wondering what this advertisement was for and where it came from. He needs his own forum, not any of us on here whom has already gotten GOT!!
Another PIF Letter
Just giving an update, that another lender, Fast and Reliable Cash caved in, though I still owed them on a current loan, and marked my account as "Paid In Full".
I went back and forth with the manager several times, as he was trying to tell me that I was bound by the laws according to the State of DE. I told him that after the many loans I've had with them, they actually OWE me a refund, so I think that is what sparked the "PIF" letter.
So I have 9 more to go..........but I haven't heard back from anyone else.
Stay tuned everyone
Great news! Good luck with the others. Keep that PIF in a safe

Another One Gone-8 more to go........
So here is what GreatPlainsLending just sent me today:
Dear Customer:
Pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.
Your account has been closed from further activity.

Now they actually OWE me a refund, but I won't hold my breath on it; I'm just glad that this is considered CLOSED!;)
Collections Agency (TR Solutions)
I have yet to hear back from any other lenders regarding my loans, so this morning, I receive a voicemail from TR Solutions....someone by the name of Mr. Swoger.
He proceeds to say that my account was just turned over to them today (10/2); however, this is my FINAL notice (10/2), and if I don't call them by 4pm CST, they will proceed and I will be served.
He left a claim # and a phone number (855-238-4061)
**How should I respond to this guy?**

I received a call from Mr. Swoger, phone number 855-238-4061 stating that this was my final notice and if I do not call back by 4pm, I will be served.
By all means, spend the money to hire an attorney in New Jersey, spend the $200 to file a complaint plus the cost of service. I will happily present the laws to the judge showing that payday loans are PROHIBITED in the state of New Jersey, which means the contract is null and void. Should cost you about $500.
So to save you money, I hereby demand that you never contact me or anyone associated with me again by any means. Mark my account as paid in full. Or you can violate the FDCPA and I will be happy to file for damages under the law of $1000.
Govern yourself accordingly
Thank You SoapLady
SoapLady, thank you for that response. I will definitely be using that one on him when he calls back, as I am aware that it was his first contact with me today! So yeah, he'll call back or someone and when they do, I am reading them the riot.
I am going to see if an address can be provided; they may not give it to me, but it's worth a try.

Does Anyone Know????
......of this (800) collector? I have been receiving several messages since last week at the following number: (281) 661-1946, which shows on my caller id; however when the message was left by someone named Mr. Miliano, he left (866) 803-6960, and that I needed to call back with a case #, as one of their clients had forwarded my information over to his office. (He never mentioned the name of his company)
I have not called back; I ignore the calls; I just wonder has anyone came across this # and this Mr. Miliano person?
Yes I'm Totally Aware....
...that all of these are illegal in the State of NJ and I do intend on ignoring all calls, as I've been doing. I just find it funny that the calls will stop for a few mos, then start back with an urgent message attached to a voicemail. Just smh!
I did google the Delaware Asset Management company and they are legitimate; however, I don't think they realize they're trying to collect on illegal debt, and I'm not telling them.
Today's Status
Today, low and behold, the same guy from DE Assets Management calls my cell phone, and of course I didn't answer; now he saying, he wants to talk to me before any papers are forwarded over to the county clerk's office for suit.
I am sure by now you know
I am sure by now you know they are illegal. Simply ignore. If calls persist, report to your SAG and the FTC, if you have not done so already. Don't let them get under your skin!

What ever happened with Mr. Swoger?
I live in NJ and have/had 14 payday loans that I've been battling since the end of October since this site woke me up to the laws of the great state of NJ! I recently received the same call from him but he doesn't leave an amount I can tie back to to figure out which payday loan my "debt" (that I've probably paid off 3x already) pertains to. How many times did he call back and did you ever send him the letter or read him the riot act if he got you on the phone?
Updating..
I apologize for just seeing your message on here, but to answer your question, NO he did not call back nor have I received anything in the mail. I was waiting for him to call back, so I could read him the riot, but to his luck, he didn't call.
How to Handle DE Asset Mgmnt Co.
I received a voicemail this afternoon from some guy name Thomas Artre', that works for Delaware Asset Management Co. He stated that there was a "legal" claim filed against my name and social security number with their office, and that It was of great importantance that I contact him back at (866) 226-1147, due to the time-sensitive nature of the matter....and that we need to discuss it in its entirety.
I believe this is from Integrity Advance in Newark, DE, as this collections agency is in Newark as well.
With Integrity Advance, I overpaid them by $1596. On a $900 loan from them, I have already paid them $2496; I'm PISSED! On January 23rd I received a call from one of their collections ppl and the very next day, I re-faxed/emailed my letter to them, staing that obviously they weren't adhering to my letter and that THEY OWE ME.
So, I didn't hear anything else from them, now all of a sudden here's this DE Asset Management Co, calling.
